Given the"one lot per 35 acres"policy in the Town of Montrose <br /> Land Use Plan,1 calculate that a total of four lots could be split from the former Legler farm. <br /> In 1982,the county and town approved Rezone Petition 2928,which rezoned 1.5 acres to R-1 <br /> and 38 acre to A-2 within the southwest"40"of the former Legler farm. As it currently stands, <br /> however,that combined R-1 and A-2 zoned area remains one legal lot. Therefore,under section <br /> 10.04(1)of the county zoning ordinance,one home may be built in the R-1 area gi one home <br /> may be built in t h e A-2 area, In order to build a home on both the A-2 area and R-1 <br /> area,a certified survey map(CSM)would have to be approved by both the town and county <br /> legally separating these two pieces of land. <br /> The current rezoning petition 7192 would result in the creation of a second buildable lot on the <br /> former Legler farm within the proposed RH-1 area,assuming a deed restriction preventing <br /> residential development is placed on the A-2"residual"parcel in that rezone. <br /> The third and fourth buildable lots could be created if(a)a CSM is later approved on the Thorpe <br /> property dividing the present one legal lot into two lots And(b)the existing area on the current <br /> Salisbury property containing the residence is divided off.
