Farin <br /> 2864 Osmundsen Road <br /> Madison, WI 53711 <br /> March 4, 1998 <br /> Mr. Tony Straseske <br /> Dane County Zoning <br /> 210 Martin Luther King Blvd. <br /> Madison, WI 53703 <br /> Dear Tony: <br /> I am writing this letter to update the information on Petition Number 7192 filed with your office March 2, <br /> 1998 at approximately 8:00 A.M. This petition asked to rezone a property located to the west of 7466 Paoli <br /> Road in the Town of Montrose legally described as: <br /> The Southwest 1/4 of the SouthEast lAleof Section 5,except the North 2 acres thereof,Town 5 North, <br /> Range 8 East,Town of Montrose, Dan County Wisconsin. <br /> In the application we requested that a 1.01 acre parcel from A-1 Exclusive to R-1A. The meets and bounds <br /> description of this parcel was attached to the petition along with three maps identifying the location of the <br /> parcel. This rezoning petition was based on an action taken by the Town of Montrose Land Use Committee <br /> in their meeting of February 23, 1998. The committee had evaluated two different proposals I submitted <br /> and recommended the proposal I submitted on March 2, subject to approval at the Town of Montrose Board <br /> Meeting on Tuesday March 3, 1998,the day after your zoning application deadline for an April 28 public <br /> hearing. <br /> At the time I submitted the application,you and I discussed the possibility that the Town of Montrose <br /> Board might reverse the recommendation of their Land Use Committee and approve the alternative request <br /> I had submitted to the Land Use Committee. This request called for the rezoning of the entire parcel to A-2 <br /> with the exception of a 2+acre portion that would be rezoned RH-1. <br /> Last night,the Town of Montrose Board reversed the recommendation of the Land Use committee and <br /> approved a modified version of my alternative request. While I don't have the exact text of the resolution, <br /> the approval took the following form: <br /> The Town of Montrose Board approved a request submitted by Felix Statz and Thomas Farin to rezone the <br /> parcel at the intersection of Paoli and Speedway Road(with the above legal description)from A-1 <br /> Exclusive to A-2 and a 2+acre portion of the property from A-1 Exclusive to RH-1 for the purpose of <br /> allowing the Farins to construct a single family residence on the property. The approval is contingent on <br /> the following conditions: <br /> • That deed restrictions be placed on the property limiting use in the A-2 portion to those uses specified <br /> in Dane County Zoning regulations for A-1 Exclusive zoning. <br /> • That before approval becomes final,the Farins must negotiate an agreement with Brian and Marie <br /> Salisbury allowing them to use a dirt road that runs North from Paoli Road through the property being <br /> purchased by the Farins and extending into the property currently owned by the Salisburys located <br /> immediately to the North. <br /> At the time I submitted Petition Number 7192,you indicated that if the reversal occurred and I notified you <br /> in a timely manner that Dane County would allow me to modify my petition to reflect final action taken by <br /> the Town of Montrose Board. You indicated that if the modifications were received in a timely manner, <br /> my Public Hearing would remain scheduled for 4/28/98. <br /> I am enclosing the following documents in addition to this letter: <br />
