The applicant agrees that most of the land is cropland. <br /> 2. These are not non-conforming parcels. This zoning parcel, with STH 19 running through <br /> it, has been zoned A-1 Exclusive Agriculture since 1981 and has sufficient size (63 acres) <br /> that it is not non-conforming. If these were non-conforming, the applicant could <br /> accomplish what is proposed without rezoning. For zoning purposes, these are not <br /> separate parcels. <br /> 3. The applicant agrees on access. <br /> 4. The northern edge of the parcel does have a small area of Seaton silt loam, which is less <br /> productive for agriculture; however, it has severe limitations for the installation of a <br /> septic tank soil absorption system. <br /> Thus, this area, north along Jacoby Road, does have a potential residential site if sited <br /> carefully. <br /> The soil maps do not have notations about a borrow site south of STH 19. <br /> 5. The applicant agrees on avoiding wetland areas. <br /> 6. The comment about parcel size relates to the statement in the plan: "The minimum lot <br /> size shall be between two and ten acres." <br /> While the Town of Berry apparently amended this policy in 1988, it has never been <br /> submitted as an amendment to the County Farmland Preservation Plan. Thus we have the <br /> town and county using two different policies. This needs to be resolved and clarified since <br /> the existing policy is somewhat confusing. <br /> 7. The criteria is not absolute and the purpose of the comments is to help policy makers <br /> decide these "judgment calls" on a consistent basis. <br />
