Staff Report <br /> Dane County Exclusive Agricultural Zoning Ordinance Text <br /> Prepared by the Department of Agriculture, <br /> Trade and Consumer Protection <br /> July 22, 1996 <br /> Dane County asked on January 15, 1996 what options were available <br /> to them to meet the requirements of a 1994 LWCB order given that <br /> the proposed rule was still pending for the program. In the 1994 <br /> order, the LWCB allowed Dane County to delay making required <br /> amendments to the ordinance pending adoption of the proposed <br /> administrative rule for the program, ATCP 51 . The rule, if adopted <br /> in its proposed form, would eliminate some of the more locally <br /> controversial amendments required to the Dane County ordinance <br /> text . <br /> This staff report comments on the Dane County ordinance text based <br /> on the requirements of ch. 91, Stats . , and the checklists used by <br /> the department and the Land and Water Conservation Board (LWCB) to <br /> review and act on certification requests . The order of items <br /> listed in the staff report directly follows the order of the <br /> requirements listed on the checklist . (See attachments A and B) . <br /> The areas addressed in this report are only those which require <br /> modification in order for the department to recommend certification <br /> of the plan amendment . <br /> Part A: Administrative Completeness - Ordinance <br /> In order for the department to recommend that the LWCB certify any <br /> exclusive agricultural zoning ordinance request, the request must <br /> be administratively complete . Attachment A identifies seven <br /> different sets of required materials for proposed exclusive <br /> agricultural zoning ordinances that must be submitted to the <br /> department in order for the applications package to be considered <br /> administratively complete . <br /> All of the required administrative materials, identified in <br /> attachment A, must be included in the application package at the <br /> time the ordinance amendments are submitted to the LWCB for <br /> certification. <br /> Part B: Certification Requirements - Ordinance <br /> Administration <br /> The ordinance does not include a provision requiring comprehensive0' <br /> ordinance revisions, or ordinance amendments extending coverage to <br /> new towns, to be certified by the LWCB in order for the landowners <br /> within the exclusive agricultural zoning districts to qualify for <br /> the farmland preservation tax credit . <br /> 1 <br />
