Dane County Ordinance Text <br /> July 22, 1996 <br /> to two persons . The ordinance can allow various categories of <br /> "farm family businesses, " but each category must meet the <br /> requirements of s . 91 . 75 (8) , Stats . <br /> Roadside stands can be allowed as a conditional use as either an <br /> agricultural-related use or a farm family business . The ordinance <br /> should specify which category of conditional use roadside stands <br /> are authorized. <br /> The ordinance does not include the necessary findings that must be <br /> made before approving a conditional use under ch. 91, Stats : that <br /> the use must be consistent with agricultural use and necessary in <br /> light of alternative locations . While the ordinance text include <br /> a consideration of alternative locations, it does not list this <br /> factor as a required finding. <br /> The ordinance does not contain a provision which requires the <br /> county to notify the department of all conditional use approvals in <br /> the exclusive agricultural use district . <br /> Farm Consolidation <br /> The ordinance does not contain a provision that would limit the <br /> parcelling off of farm buildings in a farm consolidation to a size <br /> that is no larger than reasonably necessary to accommodate the <br /> proposed use . <br /> Subsize Parcels in Exclusive Agricultural Use Districts <br /> The zoning ordinance, by itself, does not indicate that a parcel of S,, <br /> less than 35 acres is allowed to be created for agricultural use. <br /> It is likely that the restrictions for creating subsize parcels is <br /> in the county subdivision ordinance . However, it appears that <br /> under 10 . 123 (5) (b) , that parcels of less than 35 acres can be <br /> created for residences that are allowed in the district . <br /> Part D: Staff Recommendation - Ordinance <br /> The proposed ordinance is not certifiable in its current form. <br /> This report identifies the minimum changes that are necessary to <br /> make it certifiable . <br /> Prepared by Kate Lawton <br /> 3 <br />
