DANE COUNTY DEPARTMENT OF PLANNING AND DEVELOPMENT <br /> STAFF REPORT: REZONING PETITION#7241 (ADULT CHRISTIAN EDUCATION) <br /> Public hearing date: 5/26/98 <br /> I. BACKGROUND <br /> A. Current petition: <br /> The Adult Christian Education Foundation seeks to remove deed restrictions from approximately <br /> 16 acres of land in the Town of Westport. The petition would not change the zoning of the <br /> parcel, currently B-1 (Local Business District). If approved,this action would allow the <br /> Madison Country Day School, which is considering acquiring the property, to operate a private <br /> school on the premises. <br /> B. History: <br /> Adult Christian Education Foundation has operated the Yahara Center, a religious education <br /> facility, on the property since the mid-1970s. Madison Country Day School intends to renovate <br /> and reuse the existing buildings. <br /> Petition number 5706, effective on November 4, 1993 rezoned the site from R-1 to B-1, with <br /> deed restrictions limiting the uses to those associated with a business college. Petition# 5706 <br /> was made in anticipation of selling the property to the Madison Business College. That proposal <br /> fell through and the property was never sold. <br /> In 1996,the County approved Petition# 6483, which replaced the restrictions imposed by <br /> Petition# 5706 with restrictions limiting the property to the following uses: <br /> 1. Retail sales of health and wellness related items, limited to a sales area not to exceed 1,500 <br /> square feet, with no exterior storage permitted; <br /> 2. Retail service business serving health and wellness needs of individuals and groups; <br /> 3. Limited outdoor sales events, such as ice cream socials; <br /> 4. Incidental indoor storage of retail-related items or materials; <br /> 5. Offices and office buildings only as necessary and related to permitted retail uses; <br /> 6. Religious educational facilities; <br /> 7. Recreational facilities related to permitted retail uses, which are not lighted for night use; <br /> 8. Private clubs and organizations related to permitted retail uses; <br /> 9. Theaters and auditoriums related to permitted retail uses. <br /> These are the restrictions that currently apply to the property. <br /> There have been two previous petitions related to the Madison Country Day School. Conditional <br /> Use Permit 1415, to locate the school on property owned by Sam Jacobsen in Sections 29 & 32 <br /> of the Town of Westport,was denied by the ZNR on June 3, 1997. Rezoning petition 7170, <br /> which would also locate the school on the Jacobsen site,had a public hearing on March 24, 1998 <br /> and is currently pending action by the ZNR. Note that both this current petition and Petition <br /> 7170 deal with the same use at two alternative locations. Presumably only one such petition <br /> should be approved. <br />
