(d) Storage of items or materials incidental to an established retail or service use on the <br /> premises but not to serve any other business or location. Said storage shall be in an <br /> enclosed building or enclosed areas as provided by applicable zoning regulations; <br /> (e) Offices and office buildings only as necessary and related to permitted uses; <br /> (f) Schools and educational facilities except truck driving or construction equipment <br /> operator schools; <br /> (g) Recreational facilities related to permitted uses enumerated herein, and which are not <br /> lighted for night operation; <br /> (h)Private clubs and organizations related to permitted uses, and; <br /> (i) Theaters and auditoriums related to permitted uses. <br /> (This is substantially the same wording as the deed restrictions currently in effect on the <br /> property. The only change is to substitute the words "schools and educational facilities"for <br /> "religious educational facilities. ") <br /> 2. Rezoning Petition# 7170 and Conditional Use Permit Application# 1485 be withdrawn upon <br /> approval of Petition# 7241. <br /> VII. SITE AND NEIGHBORHOOD PLANNING ISSUES <br /> The existing facility was designed for institutional use,to which the site and local capacity seem <br /> reasonably well suited. The B-1 zoning district does allow certain high traffic uses, such as <br /> retail, medical clinics or office complexes that could overtax local roads and conflict with nearby <br /> residential development. <br /> VIII. ADDITIONAL COUNTY APPROVALS REQUIRED <br /> County zoning permits will be necessary before any new structures or additions to existing <br /> structures can be constructed. Renovations that involve any earthmoving in excess of 4,000 <br /> square feet or on slopes of greater than 12%, will require an erosion control plan approved by the <br /> county Land Conservation Department. <br /> IX. SUMMARY AND CONCLUSIONS <br /> The current deed restrictions make an arbitrary, and possibly illegal, distinction between <br /> religious and other types of educational facilities. There seems to be no practical reason to prefer <br /> one type of school over another. The conditions recommended by the Town of Westport appear <br /> to reasonably address this issue as well as potential concerns about other potential uses in the B-1 <br /> district. <br /> The proposed use is consistent with county ordinances,the Town of Westport Land Use Plan and <br /> other adopted plans of the County. <br />
