DANE COUNTY ORDINANCE AMENDMENT NO. 7241 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Westport. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Westport be amended to include in the B-1 Local Business <br /> (amended deed restrictions) District/s the following described land: <br /> PETITION NUMBER: 7241 <br /> Part of the N 1/2 NE 1/4 Section 23 and S 1/2 SE 1/4 Section 14, Town of Westport <br /> described as follows: Beginning at the corner common to Sections 13, 14, 23 and 24; <br /> thence S02°06'46" West along the Section line between Sections 23 and 24, 1799.83 feet <br /> to a point that is NO2°06'46" East, 800.21 feet from the quarter corner common to <br /> Sections 23 and 24; thence N52°25'42" West along the Northeasterly line of Certified <br /> Survey Map #1965. Dane County Registry to the centerline of River Road 2597.64 feet <br /> to the point of beginning. Thence N24°58'10" East 516.81 feet; thence S65°01'50" East <br /> 433.32 feet; thence N70°42'48" East 182.50 feet, thenceN89°36'00" East 615.56 feet to <br /> City of Madison corporate boundary line; thence along said line S33°57'58" West 24.23 <br /> feet to the North line of Section 23; thence continuing along the City of Madison <br /> corporate boundary line S32°14' West 1015.12 feet; thence N52°25'42" West 1,064.62 <br /> to the centerline River Road and the point of beginning.- <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b)of the Dane <br /> County Code of Ordinances. The rezoned area shall be subject to the following conditions. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane County the owner or owners of the <br /> land shall record deed restrictions and covenants as attached to the Town of Westport Resolution # 98-27 <br /> incorporating the following restrictions on said land: <br /> 1. Uses be limited to the following: <br /> (a) Retail sales of health and wellness related items,limited to a sales area not to exceed 1,500 <br /> square feet,with no exterior storage permitted; <br /> (b) Retail service business serving health and wellness needs of individuals and groups; <br /> (c) Outdoor sales events,such as ice cream socials and similar feasts or celebrations,limited to <br /> two events per year,any single event to be held on consecutive days of not more than 2 days in <br /> duration,and related to permitted uses(a)and(b)above; <br /> (d) Storage of items or materials incidental to an established retail or service use on the premises <br /> but not to serve any other business or location. Said storage shall be in an enclosed building or <br /> enclosed areas as provided by applicable zoning regulations; <br /> (e) Offices and office buildings only as necessary and related to permitted uses; <br /> (I) Schools and educational facilities except truck driving or construction equipment operator <br /> schools; <br /> (g) Recreational facilities related to permitted uses enumerated herein,and which are not lighted <br /> for night operation; <br /> (h)Private clubs and organizations related to permitted uses,and; <br /> (i) Theaters and auditoriums related to permitted uses. <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,to be <br /> consistent with the provisions of Wisconsin State Statute 91.77(1)(a),(b),(c). <br />
