The terms and conditions of these <br /> Covenants and Restrictions are severable. The invalidation of any <br /> provisions hereof by judgment or court order shall have no effect <br /> on any other provision hereof which shall remain in full force and <br /> effect. <br /> 1.1. Definition. As used herein, the term "owner" shall <br /> include holders cf the fee simple absolute interest in the Property <br /> and holders of a land contract vendee interest in the Property. <br /> The use restrict-_on contained herein shall bind those persons who <br /> occupy or use tie lands, or any building or structure located <br /> thereon, with th consent of the owner (as a tenant, licensee or <br /> otherwise) (collRctively, "Tenants") . An owner of the Property <br /> shall be responsible for the actions or inactions of Tenants in <br /> violation of thecae Covenants arid Restrictions. <br /> 12 . Costs and Fees. The Owner shall reimburse the Town for <br /> all costs and ::ees incurred by the Town for the review and <br /> preparation of t:lese Restrictions and Covenants at the time these <br /> Restrictions and Covenants are executed and shall reimburse the <br /> Town for any further costs and fees incurred with respect to the <br /> provisions of these Restrictions and Covenants. <br /> 13 . Contingent upon County Approval. These Restrictions and <br /> Covenants are contingent upon final and effective approval of <br /> Owner's petition for amendment of zoning restrictions, Rezone <br /> Petition # 7241. <br /> -8- <br />
