COMPOSITE REPORT - Page 2 APPLICATION NO. <br /> STAFF COMMENTS <br /> ZONING REVIEW <br /> Petition 7243 Kevin&Peggy Gunderson,Rutland 16 <br /> Amend Deed Restrictions in RH-1 Zoning District <br /> Rezone Petition#6025,effective 11/14/94,was Deed Restricted as follows: <br /> (A)The parcel shall not be divided;the rezoned area shall not be separated from the parcel. <br /> (B)The driveway shall be located at the edge of the field and not through the field. <br /> Kevin Connors,Director of the Dane County Land Conservation Department,has recommended a <br /> driveway location 250'West of the East PL,which"could be construed as `through the middle of the <br /> field'because the West edge of the field has good tillable soil and the East edge of the field has poor lines <br /> of sight and a steep hill. Driveway construction was begun and a Stop Work Order was issued because the <br /> driveway location did no tmeet the Deed Restriction requirements. Therefore,the applicant wishes to <br /> remove Deed Restriction(B). (There would be no change to the first Deed restriction.) <br /> REGIONAL PLANNING <br /> Petition 7243. The existing deed restriction agreed by the Town of Rutland and Dane County specified <br /> a driveway location which avoided cutting through a farm field. The proposed change would cut <br /> through the field from CTH A to the RH-1 site. <br /> According to Land Conservation staff, this location in the middle can act as a field edge between two <br /> different types of field which need different cropping and management practices. <br /> ENVIRONMENTAL HEALTH (septic, etc.) <br /> DANE COUNTY HIGHWAY <br /> Petition 7243. CTH "A"is not a controlled access highway. Any changes to existing accesses or new <br /> accesses requires a permit. Joint use driveways should be utilized wherever possible. Owner presently has <br /> a Highway Permit to locate access 200 feet west of east property line. <br /> OTHER <br /> • <br />
