DANE COUNTY ORDINANCE AMENDMENT NO. 7243 Amending Section 10.03 relating to Zoning Districts in the Town of Rutland. The Dane County Board of Supervisors does ordain as follows: That the Zoning District Maps of the Town of Rutland be amended to include in the RH-1 Rural Homes District/s the following described land: PETITION NUMBER: 7243 Part of the NW 1/4 SW 1/4 Section 16, Town of Rutland described as follows: Commencing at the West quarter corner of the said Section 16; thence N88°23'58"East 825.36 feet; thence S00°31' West 722.94 feet to the point of beginning; thence S00°31' West 296.00 thence N89°29' West 296.00 feet; thence N00°31'East 296.00 feet; thence S89°29' East 296.00 feet to the point of beginning. CONDITIONAL ZONING Conditional zoning is hereby imposed pursuant to Section 10.255(3Xa)2.(b)of the Dane County Code of Ordinances. The rezoned area shall be subject to the following conditions. DEED RESTRICTION REOUIRED This amendment will be effective,if within 90 days of its adoption by Dane County the owner or owners of the land shall record the following restrictions on said land: 1.That the driveway shall be placed 250 feet west of east boundary of the property and proceed straight south to the north edge of the tree line to the knoll then south of knoll to the homesite. 2.Deed restriction from petition#6025 shall remain"the parcel shall not be divided,the rezoned area shall not be seperated from the parcel". Said restriction shall run in favor of Dane County and the pertinent Town Board as well as the owners of land within 300 feet of the site.Failure to record the restrictions will cause the rezone to be null and void. ..AO\ The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,to be consistent with the provisions of Wisconsin State Statute 91.77(1)(a),(b),(c).
