DANE COUNTY ORDINANCE AMENDMENT NO. 7243 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Rutland. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Rutland be amended to include in the RH-1 Rural Homes District/s <br /> the following described land: <br /> PETITION NUMBER: 7243 <br /> Part of the NW 1/4 SW 1/4 Section 16, Town of Rutland described as follows: <br /> Commencing at the West quarter corner of the said Section 16; thence N88°23'58"East <br /> 825.36 feet; thence S00°31' West 722.94 feet to the point of beginning; thence S00°31' <br /> West 296.00 thence N89°29' West 296.00 feet; thence N00°31'East 296.00 feet; thence <br /> S89°29' East 296.00 feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3Xa)2.(b)of the Dane County Code of <br /> Ordinances. The rezoned area shall be subject to the following conditions. <br /> DEED RESTRICTION REOUIRED <br /> This amendment will be effective,if within 90 days of its adoption by Dane County the owner or owners of the <br /> land shall record the following restrictions on said land: <br /> 1.That the driveway shall be placed 250 feet west of east boundary of the property and proceed straight <br /> south to the north edge of the tree line to the knoll then south of knoll to the homesite. <br /> 2.Deed restriction from petition#6025 shall remain"the parcel shall not be divided,the rezoned area <br /> shall not be seperated from the parcel". <br /> Said restriction shall run in favor of Dane County and the pertinent Town Board as well as the owners of <br /> land within 300 feet of the site.Failure to record the restrictions will cause the rezone to be null and <br /> void. <br /> ..AO\ <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,to be <br /> consistent with the provisions of Wisconsin State Statute 91.77(1)(a),(b),(c). <br />
