• <br /> RESTRICTIONS <br /> it 0 0 6 S <br /> 1. WHEREAS, Robert H. Dvorak and Laurie J. Dvorak are the owners of the following <br /> described land in the Town of Rutland, Dane County, Wisconsin, to-wit: <br /> Lot 3 of Certified Survey Map No. 8116, recorded as Document No. 2741297, <br /> in Volume 43 of Maps on Pages 214-215, in the office of the Dane County <br /> Register of Deeds. <br /> 2. WHEREAS said owners desire to place certain restrictions thereon,to bind the owners <br /> and those who may acquire title hereafter. <br /> 3. NOW,THEREFORE, in consideration of the mutual benefits passing to and from the <br /> owners and those who may thereafter purchase said land and the parties named as <br /> beneficiaries of these restrictions, the following restrictions are hereby imposed: <br /> a. The following are permitted uses: <br /> (1) Service uses. <br /> (2) Warehousing and storage incidental to a permitted use. <br /> (3) Offices, office buildings and condominium office buildings devoting not <br /> more than two (2) floors to office space. <br /> (4) Utility service. <br /> (5) Distribution centers and wholesale businesses. <br /> (6) Woodworking shops. <br /> (7) Experimental laboratories not to exceed 5,000 square feet of floor space. <br /> (8) Sales and repair of lawn and garden equipment. <br /> (9) Sales, rental and leasing of new and used contractor's machinery and <br /> equipment. <br /> (10) Repairs, storage and service of contractor's machinery and equipment. <br /> (11) Sales and storage of lumber and building material. <br /> (12) Bottling plants. <br /> (13) Parking or storing of motor vehicles incidental to a permitted use. <br /> (14) Automobile body shop. <br /> a. No more than three vehicles shall be stored outside behind a <br /> confined privacy fence. <br /> These restrictions shall constitute covenants running with the land and shall be binding <br /> upon all parties now owning any part of said land, their successors, heirs and assigns, <br /> and all parties holding under them unless, pursuant to Paragraphs 5 or 6 of this <br /> instrument, said restrictions are amended or terminated. <br /> 4. The restrictions provided for herein shall be enforceable at law or equity against any <br /> party who has or acquires an interest in the land subject to the Restrictions by the <br /> following parties who are named as grantees, promisees and beneficiaries with <br /> enforcement rights: <br /> a. The County Government of Dane County, Wisconsin provided that the lands <br /> are under the jurisdiction of zoning ordinance of said County at the time the <br /> enforcement action is commenced; and <br /> 971012-70E201197 4wn <br /> Reabict. <br />
