• RESTRICTIONS it 0 0 6 S 1. WHEREAS, Robert H. Dvorak and Laurie J. Dvorak are the owners of the following described land in the Town of Rutland, Dane County, Wisconsin, to-wit: Lot 3 of Certified Survey Map No. 8116, recorded as Document No. 2741297, in Volume 43 of Maps on Pages 214-215, in the office of the Dane County Register of Deeds. 2. WHEREAS said owners desire to place certain restrictions thereon,to bind the owners and those who may acquire title hereafter. 3. NOW,THEREFORE, in consideration of the mutual benefits passing to and from the owners and those who may thereafter purchase said land and the parties named as beneficiaries of these restrictions, the following restrictions are hereby imposed: a. The following are permitted uses: (1) Service uses. (2) Warehousing and storage incidental to a permitted use. (3) Offices, office buildings and condominium office buildings devoting not more than two (2) floors to office space. (4) Utility service. (5) Distribution centers and wholesale businesses. (6) Woodworking shops. (7) Experimental laboratories not to exceed 5,000 square feet of floor space. (8) Sales and repair of lawn and garden equipment. (9) Sales, rental and leasing of new and used contractor's machinery and equipment. (10) Repairs, storage and service of contractor's machinery and equipment. (11) Sales and storage of lumber and building material. (12) Bottling plants. (13) Parking or storing of motor vehicles incidental to a permitted use. (14) Automobile body shop. a. No more than three vehicles shall be stored outside behind a confined privacy fence. These restrictions shall constitute covenants running with the land and shall be binding upon all parties now owning any part of said land, their successors, heirs and assigns, and all parties holding under them unless, pursuant to Paragraphs 5 or 6 of this instrument, said restrictions are amended or terminated. 4. The restrictions provided for herein shall be enforceable at law or equity against any party who has or acquires an interest in the land subject to the Restrictions by the following parties who are named as grantees, promisees and beneficiaries with enforcement rights: a.
