DANE COUNTY ORDINANCE AMENDMENT NO. 7026 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Rutland. <br /> The Dane County Board of Supervisors does ordain as follows: <br /> That the deed restrictions pertaining to Rezone Petition #6687, as found in Document #2828625, <br /> recorded January 27, 1997, Dane County Register of Deeds Office, be amended for the following <br /> described land in the C-2 Commercial Zoning District, Town of Rutland. <br /> PETITION NUMBER: 7026 <br /> Lot #3 of Certified Survey Map #8116, recorded in Volume 43, Pages 214-215, Certified Survey Maps, <br /> Register of Deeds Office. <br /> CONDPITONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) of the Dane County Code of Ordinances. The <br /> rezoned area shall be subject to the following conditions. <br /> 1.That a site plan shall be approved by the Planning and Development Department <br /> AMENDED DEED RESTRICTION REQUIRED <br /> This amendment will be effective,if within 90 days of its adoption by Dane County the owner or owners of the land shall record the <br /> following amended restrictions on said land: <br /> a). The following are permitted uses: <br /> 1). Service uses. <br /> 2). Warehousing and storage incidental to a permitted use. <br /> 3). Offices,office buildings and condominium office buildings devoting not more than two(2)floors to office space. <br /> 4). Utility service. <br /> 5). Distribution centers and wholesale businesses. <br /> 6). Woodworking shops. <br /> 7). Experimental laboratories not to exceed 5,000 square feet of floor space. <br /> 8). Sales and repair of lawn and garden equipment <br /> 9). Sales,rental and leasing of new and used contractor's machinery and equipment <br /> 10).Repairs,storage and service of contractor's machinery and equipment <br /> 11).Sales and storage of lumber and building material. <br /> 12).Bottling plants. <br /> 13).Parking or storing of motor vehicles incidental to a permitted use. <br /> 14).Automobile body shop. <br /> a. No more than 3 vehicles shall be stored outside behind a confined privacy fence. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town Board as well as the owners of land within 300 feet of <br /> the site. Failure to record the amended restrictions will cause this amendment to be null and void. <br /> A copy of the recorded document shall be submitted to Dane County Zoning <br /> e)\6\(\4 <br />
