COMPOSITE REPORT - Page 2 APPLICATION NO. <br /> STAFF COMMENTS <br /> REGIONAL PLANNING <br /> Petition 7030. This tire business is in an existing farm building in an agricultural preservation area of <br /> the Town of Black Earth. The town has designated two commercial sites on the plan map to the <br /> northwest of the village along USH 14,but this (#7030)is not so designated. <br /> The relevant policy is: <br /> "(2) Non-agricultural commercial uses must be generally related to agribusiness, <br /> mineral extraction, recreation enterprises,temporary storage of vehicles and limited <br /> outside storage of materials. Rezoning for such uses will be considered if the following <br /> criteria are met: <br /> (a) Be consistent with Town land use objectives and policies. <br /> (b) Have access to a state or county highway. <br /> (c) Provide a buffer between the commercial use and the adjacent noncommercial use. <br /> (d) Minimal conflict with nearby residences and farm operations. <br /> (e) No holding tank installation will be required to serve the commercial use. <br /> (f) The service offered is one generally needed by residents of the Town. <br /> (g) Written impact statements are submitted assessing the impact of the project on farms, <br /> farmland,natural resources, scenic qualities,Town roads,taxes and opportunities for <br /> employment. <br /> (h) If these criteria are met, a site plan will be required. <br /> (i) Approval of the Town Board following a public hearing." <br /> Staff Comments <br /> The application does not indicate the amount or percentage of agriculture-related tire business as <br /> opposed to non-agricultural business. <br /> (a) The business is in an existing farm building;therefore,preservation of agricultural land is not <br /> an issue. <br /> (b) Access is to CTH KP. <br /> (c) This site is within an existing farm building complex which does not allow buffer possibilities. <br /> (d) As noted above,this site is close to a residence and other farm buildings. There is no other <br /> nearby residence;however, limited non-farm residential development is proposed to the south <br /> across CTH KP(Petition#6974--July 1997 pending). <br /> (e) There is no apparent need for a holding tank. <br /> (f) Tires are generally needed by owners of vehicles urban and rural. <br /> (g) No written impact statements have been submitted. <br /> (h) If the rezoning is approved, there needs to be a site plan which distinguishes the commercial <br /> use from the agricultural use. <br /> In addition, if the site is rezoned C-2, it should be conditionally zoned for the tire business only since <br /> many other uses permitted by the C-2 district would be incompatible at this site. <br />
