DANE COUNTY ORDINANCE AMENDMENT NO. 7031 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Vienna. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Vienna be amended to include in the RH-1 Rural Homes District/s <br /> the following described land: <br /> PETITION NUMBER: 7031 <br /> A part of the SW 1/4 SW 1/4 of Section 22, Town of Vienna described as follows: <br /> Commencing at the Southwest corner of said Section 22; thence North along the West line <br /> of the SW 1/4 SW 1/4 of Section 22, and the centerline of Patton Road, 991.37 feet; to <br /> the point of beginning; thence continuing North 156.00 feet; thence S 88° 33' 57"East, <br /> 193.11 feet; thence N 02° 00' 14' East, 19.50 feet; thence S 85° 21' 11"East 247.12 feet; <br /> thence S 20° 43' 26"East, 250.00 feet; thence N 89° 56' 22"West, 193.35 feet; thence N <br /> 37° 37' 28"West, 96.67 feet; thence N 88° 33' 57"West, 279.57 feet to the point of <br /> beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b)of the Dane County Code of <br /> Ordinances. The rezoned area shall be subject to the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed description/s is/are intended to describe land for which a certified survey map will be prepared <br /> for approval and recorded. This amendment will become effective, if within 90 days of its approval by Dane <br /> County,a certified survey map that describes the land to be rezoned is recorded in the office of the Dane County <br /> Register of Deeds. Failure to record the survey will cause the rezone to be null and void. Two copies of the <br /> recorded survey shall be submitted to Dane County Zoning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) of the Dane County Code of <br /> Ordinances. The rezoned area shall be subject to the following conditions. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective,if within 90 days of its adoption by Dane County the owner or owners of the <br /> land shall record the following restrictions on said land: <br /> 1. To prohibit further residential development on the balance of parcel number 0909-223-9000, containing <br /> approximately 32.7 acres. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town Board as well as the,owners id'; <br /> within 300 feet of the site. Failure to record the restrictions will cause the rezone to be null and void. <br /> A copy of the recorded document shall be submitted to Dane County Zoning. / 'S /1 <br /> b‘\ <br /> °.74 <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,to be <br /> consistent with the provisions of Wisconsin State Statute 91.77 (1)(a),(b),(c). <br />
