DANE COUNTY ORDINANCE AMENDMENT NO. 7031 Amending Section 10.03 relating to Zoning Districts in the Town of Vienna. The Dane County Board of Supervisors does ordain as follows: That the Zoning District Maps of the Town of Vienna be amended to include in the RH-1 Rural Homes District/s the following described land: PETITION NUMBER: 7031 A part of the SW 1/4 SW 1/4 of Section 22, Town of Vienna described as follows: Commencing at the Southwest corner of said Section 22; thence North along the West line of the SW 1/4 SW 1/4 of Section 22, and the centerline of Patton Road, 991.37 feet; to the point of beginning; thence continuing North 156.00 feet; thence S 88° 33' 57"East, 193.11 feet; thence N 02° 00' 14' East, 19.50 feet; thence S 85° 21' 11"East 247.12 feet; thence S 20° 43' 26"East, 250.00 feet; thence N 89° 56' 22"West, 193.35 feet; thence N 37° 37' 28"West, 96.67 feet; thence N 88° 33' 57"West, 279.57 feet to the point of beginning. CONDITIONAL ZONING Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b)of the Dane County Code of Ordinances. The rezoned area shall be subject to the following conditions. CERTIFIED SURVEY REQUIRED The above listed description/s is/are intended to describe land for which a certified survey map will be prepared for approval and recorded. This amendment will become effective, if within 90 days of its approval by Dane County,a certified survey map that describes the land to be rezoned is recorded in the office of the Dane County Register of Deeds. Failure to record the survey will cause the rezone to be null and void. Two copies of the recorded survey shall be submitted to Dane County Zoning. CONDITIONAL ZONING Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) of the Dane County Code of Ordinances. The rezoned area shall be subject to the following conditions. DEED RESTRICTION REQUIRED This amendment will be effective,if within 90 days of its adoption by Dane County the owner or owners of the land shall record the following restrictions on said land: 1. To prohibit further residential development on the balance of parcel number 0909-223-9000, containing approximately 32.7 acres. Said restrictions shall run in favor of Dane County and the pertinent Town Board as well as the,owners id'; within 300 feet of the site. Failure to record the restrictions will cause the rezone to be null and void. A copy of the recorded document shall be submitted to Dane County Zoning. / 'S /1 b‘\ °.74 The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,to be consistent with the provisions of Wisconsin State Statute 91.77 (1)(a),(b),(c).
