s � DANE COUNTY ORDINANCE AMENDMENT NO. 7053 Amending Section 10.03 relating to Zoning Districts in the Town of Albion. The Dane County Board of Supervisors does ordain as follows: That the Zoning District Maps of the Town of Albion be amended to include in the A-2(2) Agricultural District/s and RH-2 Rural Homes District/s the following described land: PETITION NUMBER: 7053 To RH-2: Part of the SE 1/4 of Section 3, Town of Albion, described as follows: Commencing at the E 1/4 corner of Section 3; thence West along the North line of the SE 1/4 of said Section, 2750 feet to the point of beginning; thence South 1050 feet; thence East 480 feet to the centerline of S.T.H. 73; thence N 30° W along said centerline, 1100 feet to the North line of the SE 1/4;thence West 200 feet to the point of beginning. To A-2(2): Part of the SE 1/4 of Section 3, Town of Albion, described as follows: Commencing at the E 1/4 corner of Section 3; thence West along the North line of the SE 1/4, 2550 feet to the centerline of STH 73; thence S 30° E along said centerline, 400 feet to the point of beginning; thence continue S 30° E, 400 feet; thence N 60° E, 255 feet; thence N 30°W, 400 feet; thence S 60°W, 255 feet to the point of beginning. CONDTITONAL ZONING Conditional zoning is hereby imposed pursuant to Section 10.255(3Xa)2.(b)of the Dane County Code of Ordinances. The rezoned area shall be subject to the following conditions. CERTIFIED SURVEY REQUIRED The above listed description/s is/are intended to describe land for which a certified survey map will be prepared for approval and recorded. This amendment will become effective, if within 90 days of its approval by Dane County,a certified survey map that describes the land to be rezoned is recorded in the office of the Dane County Register of Deeds. Failure to record the survey will cause the rezone to be null and void. Two copies of the recorded survey shall be submitted to Dane County Zoning. DEED RESTRICTION REQUIRED This amendment will be effective,if within 90 days of its adoption by Dane County the owner or owners of the land shall record the following restrictions on said land: 1.There shall be no residential development on the A-2(2)rezone area. Said restriction shall run in favor of Dane County and the pertinent Town Board as well as the owners of land within 300 feet of the site.Failure to record the restrictions w ll c use the rezone to be null and void. CcL The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,to be consistent with the provisions of Wisconsin State Statute 91.77(1)(a),(b),(c).
