s � <br /> DANE COUNTY ORDINANCE AMENDMENT NO. 7053 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Albion. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Albion be amended to include in the A-2(2) Agricultural District/s <br /> and RH-2 Rural Homes District/s the following described land: <br /> PETITION NUMBER: 7053 <br /> To RH-2: Part of the SE 1/4 of Section 3, Town of Albion, described as follows: <br /> Commencing at the E 1/4 corner of Section 3; thence West along the North line of the SE <br /> 1/4 of said Section, 2750 feet to the point of beginning; thence South 1050 feet; thence <br /> East 480 feet to the centerline of S.T.H. 73; thence N 30° W along said centerline, 1100 <br /> feet to the North line of the SE 1/4;thence West 200 feet to the point of beginning. <br /> To A-2(2): Part of the SE 1/4 of Section 3, Town of Albion, described as follows: <br /> Commencing at the E 1/4 corner of Section 3; thence West along the North line of the SE <br /> 1/4, 2550 feet to the centerline of STH 73; thence S 30° E along said centerline, 400 feet <br /> to the point of beginning; thence continue S 30° E, 400 feet; thence N 60° E, 255 feet; <br /> thence N 30°W, 400 feet; thence S 60°W, 255 feet to the point of beginning. <br /> CONDTITONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3Xa)2.(b)of the Dane County Code of <br /> Ordinances. The rezoned area shall be subject to the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed description/s is/are intended to describe land for which a certified survey map will be prepared <br /> for approval and recorded. This amendment will become effective, if within 90 days of its approval by Dane <br /> County,a certified survey map that describes the land to be rezoned is recorded in the office of the Dane County <br /> Register of Deeds. Failure to record the survey will cause the rezone to be null and void. Two copies of the <br /> recorded survey shall be submitted to Dane County Zoning. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective,if within 90 days of its adoption by Dane County the owner or owners of the <br /> land shall record the following restrictions on said land: <br /> 1.There shall be no residential development on the A-2(2)rezone area. <br /> Said restriction shall run in favor of Dane County and the pertinent Town Board as well as the owners of <br /> land within 300 feet of the site.Failure to record the restrictions w ll c use the rezone to be null and <br /> void. <br /> CcL <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,to be <br /> consistent with the provisions of Wisconsin State Statute 91.77(1)(a),(b),(c). <br />
