In terms of density requirements,the density allowed in the Upper Agricultural Terrace <br /> District is stated on page 19 of the Town Plan : <br /> • "maximum of 1 residential lot per 40 acres <br /> outside of the Urban Service Area." <br /> Only the land outside of the Urban Service Area can be counted to calculate the splits <br /> available. In this case,the land that falls outside of the Urban Service Area consists of <br /> approximately 34.7 acres. The 77 acres that fall in the Urban Service Area cannot be <br /> counted for the density computation. The proposal of creating three lots does not <br /> comply with the density requirements of the Town Plan. <br /> D. The criteria regarding land division policies are listed on Chapter B of the Town of <br /> Mazomanie Land Use Plan. Two of them are stated as follows: <br /> "b. The agricultural density provision allows for(1)residential building site <br /> per 40 acres exclusive of the original farm residence." <br /> "d.All rezonings since adoption of Exclusive Agricultural Zoning by the <br /> Town of Mazomanie on March 29, 1979, shall be taken into account. " <br /> Regarding criteria b., if the area in question was rounded to 40 acres (it is 36.4 acres), <br /> the remaining issue would be whether the existing residence is the original farm <br /> residence. No records or building permits on the residence were found. An aerial photo <br /> of 1976 shows the house and accessory buildings already built. <br /> Regarding criteria d.,the land had a rezone since the adoption of Al-EX by the town: <br /> rezone No 2328 dated September 15, 1979. According to d., such rezone would be <br /> counted as a split. <br /> E. No town action report was received. At their last meeting, the Town Board tabled the <br /> vote on the petition. <br /> III. SUMMARY <br /> A. The rezone in question does not comply with the Town Plan. <br /> B. One buildable lot could be created in the northern part of the property if: <br /> • the goals of the district were not considered in conflict with the proposal; <br /> • 34.7 acres of land were counted as 40 acres for the density calculation; <br /> • the existing residence was the original farm residence; and, <br /> • criteria d. of the Town Plan Chapter on Land Division Policies was waived. <br />
