• <br /> P 731 <br /> IN CONSIDERATION of the above, the parties agree: <br /> 1. Property Owner will petition to rezone the property <br /> to: C-2 <br /> The Property Owner represents that the property will be <br /> used for outdoor RV sales only <br /> , and no other purpose. <br /> 2. If the Property Owner later transfers, sells or <br /> conveys any legal or equitable interest in the property he shall <br /> first: <br /> (a) Petition the Town and Dane County to rezone the <br /> property to the zoning classification of LC-1 <br /> (b) If Property Owner fails to do such, Property Owner <br /> does hereby appoint the Town Board Chairman of the Town to make <br /> such application on Property Owner's behalf, such appointment <br /> being irrevocable; <br /> (c) Property Owner shall advise his prospective <br /> purchaser of the terms and conditions of this AGREEMENT; <br /> (d) All costs of rezoning and enforcing this <br /> AGREEMENT, including the Town's reasonable attorney's fees, shall <br /> be paid by Property Owner. <br /> - 2 - <br /> • <br />
