This development is only 200 feet <br /> from Story Creek. Unless there is extremely diligent erosion <br /> control and stormwater management, there will clearly be erosion <br /> into Story Creek and the adjacent wetland. <br /> Finally, it is important for the Committee to recognize that <br /> under Section 91 .75 (5) of the Wisconsin Statutes, a conditional use <br /> in an exclusive agriculture area is limited to uses "that are con- <br /> sistent with agricultural use and are found to be necessary in <br /> light of the alternative locations available for such uses . " I do <br /> not see how anyone can find that this proposal in this location <br /> meets that statutory test. <br /> After all, a "use consistent with agricultural use" is defined <br /> in State Statute 91 . 01 (10) to have to meet all of the following <br /> conditions: <br /> (1) The activity will not convert land that has been devoted <br /> primarily to agricultural use; <br /> (2) The activity will not limit the surrounding land' s <br /> potential for agricultural use; <br /> (3) The activity will not conflict with agricultural <br /> operations on the land subject to a Farmland Preservation <br /> Agreement; <br /> (4) The activity will not conflict with agricultural <br /> Qperation on other properties . <br /> I have enclosed DNR wetland and woodlot maps to highlight the <br /> conflicts between this proposed development and the adjacent <br /> resource protection areas. As you will see, this area is also the <br /> location of the head waters of the Story Creek trout stream. <br /> 2 . Public Safety. The applicant proposes building an 8, 300 <br /> square foot building with a maximum capacity of 24 occupants on a <br /> site that is 55% woodland and 45% wetland. The location of the <br /> building is 1, 400 feet from Tipperary Road. Three-fourths of the <br /> driveway is over wetlands and the culvert is only 24 feet wide and <br /> placed at an angle to the driveway. <br />
