RESTRICTIONS AND COVENANTS <br /> To protect and preserve the values those lands described as Lots One, Two, and Three in Certified Survey Map <br /> No. X jO recorded in the Office of the Register of Deeds for Dane County, in Volume y3 of Certified Survey <br /> Maps, Page ) on a 1 r q , 1996, located in the Township of Perry, Dane County, Wisconsin, <br /> (hereinafter referred to as "LANDS") for the mutual benefit and protection of all present and future owners, it is <br /> agreed that the LANDS shall be subject to the following protective covenants,easements, and servitudes which are <br /> to run with the land and shall be binding on all parties hereto. Said LANDS are currently owned by Clark W. <br /> Kepplinger and Sherry E. Wilde,hereinafter referred to as "GRANTORS". <br /> V 32048 P 62 <br /> TERMS: <br /> These covenants are to run with the land and shall be binding on all parties and all persons claiming under <br /> them for a period of thirty years, after which time said covenants shall be automatically extended for successive <br /> periods of ten years unless an instrument signed by a majority of the then owners of Lots One, Two, and Three <br /> have been recorded, agreeing to change said covenants in whole or in part. Lots One and Three, herein <br /> above-described, shall not at any time, be further subdivided,nor sold except as a whole, but this restriction shall <br /> not prevent the purchasers from conveying any part of the said real estate hereby conveyed to the owner or owners <br /> of said lots adjoining the land herein conveyed. <br /> ENFORCEMENT: <br /> Enforcement shall be by proceeding at law or in equity against any person or persons violating or <br /> attempting to violate any covenant either to restrain a violation or to recover damages. <br /> SEVERABILITY: <br /> Invalidation of any one of these covenants by judgment or court order shall in no way affect any of the <br /> other provisions which shall remain in full force and effect. All of the restrictions herein contained are severable <br /> and divisible, and any restriction which is found to be unenforceable, invalid, illegal,or unconstitutional shall not <br /> affect any of the other restrictions herein. <br /> LAND USE AND BUILDING TYPE <br /> Lots One, Two and Three shall be restricted to use for single family residential purposes. No dwelling <br /> house or other house or structure shall be erected on the conveyed property until the plans and specifications with <br /> the proposed site therefor have been submitted to and approved by the GRANTORS as to outward appearances and <br /> design, and a written permit issued therefor; provided, however if the approving parties fail to approve or <br /> disapprove such plans and specifications within 30 days after same have been submitted such approval shall not be <br /> required. <br /> No manufacturing or commercial business activity shall be carried on the premises of Lots One, Two and <br /> Three. This restriction shall not be construed, however, as preventing a self-employed party from engaging in his <br /> trade or business from his/her home office. <br /> In addition to the restrictions stated above, the following uses are prohibited on Lots One, Two and Three: <br /> I Community living arrangements of any size. <br /> Municipal buildings <br /> Sheltered facilities for battered woman or other persons. <br />
