DANE COUNTY ORDINANCE AMENDMENT NO. 7106 Amending Section 10.03 relating to Zoning Districts in the Town of Berry. The Dane County Board of Supervisors does ordain as follows: That the Zoning District Maps of the Town of Berry be amended to include in the A-2 Agricultural Districts the following described land: PETITION N17M ER: 7106 Part of the East 1/ of Section 17, Town of Berry, described as follows: Beginning at the East 1/4 corner of the said Section 17; thence West to the SW corner of the SE 1/4 of the NE 1/4; thence South along the 40 line 150 feet; thence West to the North-South 1/4 line; thence North to the NW corner of the SW 1/4 of the NE 1/4; thence East to the NW corner of CSM No. 740; thence South 290.54 feet to the SW corner of said CSM No. 740; thence S 88°13'30"E 150.00 feet to the section line; thence South to the point of beginning. Also, commencing at the Southeast corner of the said Section 17; thence West 490 feet to the point of beginning; thence West 410 feet; thence North 1050 feet; thence East 900 feet; thence South 835 feet along the section line; thence West 490 feet; thence South 215 feet to the point of beginning. CONDITIONAL ZONING Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b)of the Dane County Code of Ordinances. The rezoned area shall be subject to the following conditions. 1.That the A-2 rezone area(lot 5)be deleted and that the rezone areas be restricted to one animal unit per acre. DEED RESTRICTION REQUIRED This amendment will be effective,if within 90 days of its adoption by Dane County the owner or owners of the land shall record the following restrictions on said land: 1. That the following described property be deed restricted for no residential development: A part of the SE 1/4 of the NE 1/4 of Section 17,Town of Berry described as follows: Beginning at the East quarter corner of said Section 17;thence N00°12'34"East along the Section line 1006.02 feet to the Southeast corner of CSM#740;thence along said CSM N88°01'21"West 150.17 feet to the Southwest corner thereof;thence along said CSM N00°16'00"East 305.37 feet to the Northwest corner thereof; thence S89°42'00"West 400.19 feet;thence S02°40'04"West 706.61 feet;thence S02°37'48"East 611.39 feet;thence N89°46'43"East 550.00 feet along the East-West quarter line to the point of beginning; Said restriction shall run in favor of Dane County and the pertinent Town Board as well as the owners of land within 300 feet of the site.Failure to record the restrictions will cause the rezone to be null and void. °S ..
