DEED RESTRICTION <br /> PAGE 2 <br /> II. WHEREAS said owner desires to place certain restrictions thereon, <br /> to bind the owner and those who may acquire title hereafter. <br /> III. NOW, THEREFORE, in consideration of the mutual benefits passing to <br /> and from the owner and those who may hereafter purchase said land <br /> and the parties named as beneficiaries of these restrictions, the <br /> following restrictions are hereby imposed: <br /> 1. Approval of a developer agreement for construction of public <br /> road which will meet county road specifications. <br /> 2. A building envelope of not greater than two (2) acres in size <br /> shall be designated for each of the four lots created by this <br /> certified survey map at the time a building permit is issued for <br /> said lot, and no building shall thereafter be constructed outside <br /> of this designated building envelope for that lot. <br /> 3. The balance of the land comprising each of the four lots created <br /> by this certified survey map outside of the designated building <br /> envelope shall be designated as a non buildable area. Use of this <br /> area shall be limited to farming as to those portions of said lot <br /> which have been used for farming in any of the five years preceding <br /> the recording of these restrictions. Uses of the woodland preserve <br /> areas of each lot herein created shall be limited to <br /> those uses and practices which are consistent with accepted <br /> standards of woodland husbandry and management <br /> to recreational uses consistent with the woodland character of said <br /> lands, including, without limitation, hiking and horseback riding <br /> trails. <br /> 4. No structures shall be constructed whose height is such that <br /> any portion of that structure would extend above an imaginary line <br /> running from a point six (6) feet above the top surface of a <br /> concrete pad at the base of a green monument sign reading "Indian <br /> Lake" located near the southwest corner of the main parking lot at <br /> Indian Lake County Park on a straight line extending to the treetop <br /> horizon at the location of the structure. The intent of this <br /> restriction is to limit the height of structures so that those <br /> structures do not stand above the brow of the wooded hillside on <br /> which the lots are located when viewed from the sign at the County <br /> Park. <br /> 5. The colors of the exterior surfaces of all structures <br /> constructed upon any of the lots herein created shall be limited to <br /> natural earth tones in the brown, green, umber or grey families of <br /> colors. <br /> 6. Conifer or other plant materials screens shall be planted to the <br /> west side of any structure constructed on Lots One (1) and two (2) <br /> and to the south side of any structure constructed on lot four (4) . <br /> The intent of this covenant is to soften the visual impact of such <br /> structures, not to totally screen them from view.
