The deed restriction reads as follows: <br /> 1. To prohibit residential development on parcel # 0606-224-8140 and to prohibit <br /> residential development on the balance of parcel #'s 0606-224-8540 and 0606-224- <br /> 9500 and that all development rights have been exhausted. <br /> The wording in the second portion of the deed restriction states the balance of two parcels <br /> and this implies exclusive of the lot(s) approved in rezone Petition # 7113. I realize the <br /> wording could be more specific however the deed restriction is approved by the zoning <br /> committee and county board prior to the CSM being recorded. There is no question that lot <br /> 3 is not deed restricted but has been rezoned to RH-3 to allow for residential development. <br /> In conclusion this lot is a buildable lot and I can see no reason why a zoning permit could <br /> not be issued for Lot 3. Please let me know this afternoon if this letter resolves your <br /> concerns, my fax is Gregoriusca co.dane.wi.us.
