'.... <br /> Minority Report January 22, 1998 <br /> This zoning request should be denied. It violates the Town of Pleasant Springs Land Use <br /> Plan. It also violates the Dane County Land Use Plan since all town plans are <br /> incorporated with and become part of the Dane County Plan. In particular, it violates the <br /> policy of one residence per 35 acres of farm land owned as of June 6, 1978. <br /> For some reason we went down the path of a farm residence on land zoned A-1 EX. The <br /> petitioners requested a rezone of acreage currently zoned A-2. The requested zoning <br /> was for A-2(2) for 2 acres of a 26 acre parcel and A-1 EX for the remaining 24 acres of <br /> the 26 acre parcel. The stated intent was to combine the remaining 24 acres with another <br /> 35 acres already owned by the petitioners. This would create a 59 acre parcel zoned A-1 <br /> EX and a 2 acre parcel zoned A-2(2). <br /> Further, the petitioners stated they intended to build a house on the land now zoned A-1 <br /> EX. When advised that this would not be allowed due to the Town Land Use Plan the <br /> petitioners indicated that the Dane County Zoning Department had told them they could <br /> build on A-1 EX land. There was also a caution to the petitioners that they would have to <br /> meet the income requirement of Dane County Ordinances. <br /> The Town Plan Commission and the Town Board felt the County was advising the <br /> petitioners that they could build on A-1 EX regardless of what the Town said. The <br /> September 17, 1997 letter written by Kenneth Schuck and Berniece Rein (attached) was <br /> an attempt to clarify the concerns of the Town Board and their understanding of the <br /> advice provided by the County Zoning Department to the petitioners. Note the last two <br /> sentences in our first paragraph, which indicated the belief the Town had no way to stop <br /> the building of a second home. That letter addressed concerns about the income <br /> requirements of Dane County Ordinances and the density provisions of the Land Use <br /> Plan. <br />
