Blvd <br /> Madison, Wisconsin 53709-0001 <br /> Re: Zoning Petition 6919 Certified Survey Map(Schutz) <br /> Dear Sirs: <br /> • <br /> I recently received a copy of a letter, copy enclosed, directed to Williamson Surveying <br /> Company concerning Mr. Schutz's zoning petition and certified survey. The letter <br /> indicates that the petition and survey are conditionally approved subject to a list of ten <br /> requirements. As the Town of Vienna Clerk, I am quite confused by a number of the <br /> items in the list. <br /> Item number two indicates that the Town must again approve petition II 6919 because it <br /> was in some way amended. Item three indicates that a deed restriction was also placed <br /> on the property. There was not attempt or decision of the Town Board to place a deed <br /> restriction on this property when it sent you it's recommendation for approval... nor was <br /> there an understanding that the petition was or needed to he amended. I will enclose a <br /> copy of the town action report. If my placing the words "Single Family Residential Use <br /> only" were not properly understood- they should not have been. Our clear understanding <br /> was that the requested zoning of "RI 1-1"already zoned the parcel for only single family <br /> residential use... and in those words were placed on the action report they were to only <br /> confirm our understanding. Certainly not to amend or require a separate deed restriction <br /> on that property. Please accept this letter as the documentation to clarify our intent and <br /> the action to approve on May 5th by both the Vienna Plan Committee and the Town of <br /> Vienna Board of the certified survey and the requested zoning change. I have also <br /> enclosed a copy of our earlier letter explaining our approval and without any intent for a <br /> deed restriction or an amended petition which required further approval by us. <br /> I was also confused by items numbered six and seven concerning the vision corner. I do <br /> have a few questions on that. Is that something new which is supposed to be addressed <br /> by the town when a recommendation is submitted to Dane County? I have never been <br /> aware of such a need in past recommendations. Who is responsible for verifying that <br /> such an acceptable vision corner is present? The Town of Vienna viewed the proposed <br /> driveway site and found the vision corner to be acceptable when we went through the <br /> normal process of approving a driveway permit... and prior to a building permit being <br /> issued. If there have been changes made in our requirements I would very much <br /> appreciate our being made aware of those changes and in being informed in how we can <br /> satisfy what we are being required to provide to you for you review and approval. <br />
