The proposed re-zoning also raises several technical issues: <br /> 1. A potential second driveway from the new lot—During discussions before <br /> the Town Board, the petitioner suggested the possibility of using a lane to an <br /> existing pole shed as the driveway for the second lot. Inquiries by the Town <br /> Board Clerk could find no record of county approval of this second access off <br /> Highway Y. The proposed second access is located within 100 yards of the <br /> crest of a hill on Highway Y, making it extremely uncertain whether such a <br /> second driveway could be approved under current regulations. (See attached <br /> pictures of the proximity of the driveways and the crest of the hill on <br /> Highway Y.) <br /> At the hearing before your committee, the petitioner during her rebuttal <br /> comments provided a map indicating the driveway for the second house <br /> would not be located as previously proposed, but would access off the <br /> current driveway. In the event the committee decides to approve the <br /> petition, there should be, at the least, a condition attached that no new <br /> driveways off Highway Y for these lots be allowed. <br /> 2. A determination of "immediate intended use" of the parcel—In the Roxbury <br /> Town Land Use Plan (page 7, under general policies for "Unsewered <br /> Development District"), it states: "When re-zoning, only that portion of land <br /> necessary for the immediate intended use will be rezoned." <br /> At Town Board and Planning Commission hearings, the petitioner stated <br /> several times that they had no immediate plans to build a house on the <br /> second lot. It was indicated she would do so, at some unspecified point in <br /> the future, but the suggestion was made that there were no such immediate <br /> plans. If there are no immediate plans, as suggested, a question can be <br /> raised whether the petition is consistent or inconsistent with the policy <br /> stated above. If they have no immediate intended use, can the parcel be re- <br /> zoned and remain consistent with the policy? <br /> Although these issues represent our personal concerns, it should be noted they are <br /> shared by other neighbors as well. Seven adjacent and nearby property owners, in <br /> both the Towns of Roxbury and Mazomanie, signed a petition against the re-zoning, <br /> which was placed in the record by the Town Board. All these parties have shared <br /> similar concerns as ours. <br /> Attached to this letter are three other letters from nearby and adjacent neighbors <br /> who, for their own reasons, oppose the re-zoning. <br /> If you have any questions, we'd be happy to respond. <br /> Thank you for consideration of these important issues. <br />
