DANE COUNTY ORDINANCE AMENDMENT NO. 7135 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Dunkirk. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Dunkirk be amended to include in the RH-3 Rural Homes District/s <br /> the following described land: <br /> PETITION NUMBER: 7135 <br /> Part of the SE 1/4 SE 1/4 of Section 21, Town of Dunkirk, described as follows: <br /> Beginning at the Southeast corner of said Section 21; thence N89°37'31" West along the <br /> South line of said 1/4 1/4, 679.31 feet; thence N00°20'44" West, 936.49 feet; thence <br /> S89°48'54" East, 67 feet; thence N00°20'44" West, 300 feet; thence S89°48'54" East, <br /> 643.44 feet; thence S01°06'02" West along the East line of said 1/4 1/4, 1236.13 feet to <br /> the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b)of the Dane County Code of <br /> Ordinances. The rezoned area shall be subject to the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed description/s is/are intended to describe land for which a certified survey map will be prepared <br /> for approval and recorded. This amendment will become effective, if within 90 days of its approval by Dane <br /> County,a certified survey map that describes the land to be rezoned is recorded in the office of the Dane County <br /> Register of Deeds. Failure to record the survey will cause the rezone to be null and void. Two copies of the <br /> recorded survey shall be submitted to Dane County Zoning. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective,if within 90 days of its adoption by Dane County the owner or owners of the <br /> land shall record the following restrictions on said land: <br /> 1. There shall be no new residences allowed on the RH-3 rezone area. <br /> 2.there shall be no residential construction permitted on the remaining portion of parcel 0511-214-9640 <br /> and parcel 0511-214-9141. <br /> Said restriction shall run in favor of Dane County and the pertinent Town Board as well as the owners of <br /> land within 300 feet of the site.Failure to record the restrictions will cause the rezone to be null and <br /> void. --� <br /> The rezoned area shall be subject to the following conditions. <br /> 1.Final certified survey map shall be submitted to the township. Q <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,to be <br /> consistent with the provisions of Wisconsin State Statute 91.77(1)(a),(b),(c). <br />
