DANE COUNTY ORDINANCE AMENDMENT NO. 7135 Amending Section 10.03 relating to Zoning Districts in the Town of Dunkirk. The Dane County Board of Supervisors does ordain as follows: That the Zoning District Maps of the Town of Dunkirk be amended to include in the RH-3 Rural Homes District/s the following described land: PETITION NUMBER: 7135 Part of the SE 1/4 SE 1/4 of Section 21, Town of Dunkirk, described as follows: Beginning at the Southeast corner of said Section 21; thence N89°37'31" West along the South line of said 1/4 1/4, 679.31 feet; thence N00°20'44" West, 936.49 feet; thence S89°48'54" East, 67 feet; thence N00°20'44" West, 300 feet; thence S89°48'54" East, 643.44 feet; thence S01°06'02" West along the East line of said 1/4 1/4, 1236.13 feet to the point of beginning. CONDITIONAL ZONING Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b)of the Dane County Code of Ordinances. The rezoned area shall be subject to the following conditions. CERTIFIED SURVEY REQUIRED The above listed description/s is/are intended to describe land for which a certified survey map will be prepared for approval and recorded. This amendment will become effective, if within 90 days of its approval by Dane County,a certified survey map that describes the land to be rezoned is recorded in the office of the Dane County Register of Deeds. Failure to record the survey will cause the rezone to be null and void. Two copies of the recorded survey shall be submitted to Dane County Zoning. DEED RESTRICTION REQUIRED This amendment will be effective,if within 90 days of its adoption by Dane County the owner or owners of the land shall record the following restrictions on said land: 1. There shall be no new residences allowed on the RH-3 rezone area. 2.there shall be no residential construction permitted on the remaining portion of parcel 0511-214-9640 and parcel 0511-214-9141. Said restriction shall run in favor of Dane County and the pertinent Town Board as well as the owners of land within 300 feet of the site.Failure to record the restrictions will cause the rezone to be null and void. --� The rezoned area shall be subject to the following conditions. 1.Final certified survey map shall be submitted to the township. Q The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,to be consistent with the provisions of Wisconsin State Statute 91.77(1)(a),(b),(c).
