r i <br /> 1 <br /> DANE COUNTY ORDINANCE AMENDMENT NO. 7138 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Middleton. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Middleton be amended to include in the RH-1 Rural Homes <br /> Districts the following described land: <br /> PETITION NUMBER: 7138 <br /> Part of the SW 1/4 SE 1/4 Section 18, Town of Middleton, described as follows: Lots 1, <br /> CSM 7429 found in Volume 38, Page 157 of Certified Survey Maps Dane County <br /> Register of Deeds Office. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3Xa)2.(b)of the Dane County Code of <br /> Ordinances. The rezoned area shall be subject to the following conditions. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective,if within 90 days of its adoption by Dane County the owner or owners of the <br /> land shall record the following restrictions on said land: <br /> 1.The rezone area shall be restricted to horses only,with a maximum of 2 horses at any given time. <br /> 2.No livestock may be permitted except that 2 horses may be permitted as long as it remains under the <br /> ownership of Joel and Vicky Dohmeier. <br /> Said restriction shall run in favor of Dane County and the pertinent Town Board as well as the owners of <br /> land within 300 feet of the site.Failure to record the restrictions will cause the rezone to be null and <br /> void. <br /> The rezoned area shall be subject to the following conditions. <br /> 1.The Dohmeiers agree to construct and maintain a fence sperating their property from the Wayne Rounds <br /> property to the east. <br /> 2.The property owners shall file a manure handling plan with the Town of Middleton and Dane County <br /> Enviromental Health for approval. <br /> 3.The Town of Middleton and Dane County shall be approving parties to the deed restrictions. <br /> F <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,to be <br /> consistent with the provisions of Wisconsin State Statute 91.77(1)(a),(b),(c). <br />
