DANE COUNTY ORDINANCE AMENDMENT NO. 7144 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Rutland. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Rutland be amended to include in the RH-1 and RH-4 Rural Homes <br /> Districts the following described land: <br /> PETITION NUMBER: 7144 <br /> Part of the NW 1/4 of the SW 1/4 of Section 15, Town of Rutland described as follows: <br /> TO RH-1: Commencing at the Southwest corner of said Section 15; thence East along <br /> the South line of said Southwest quarter, 1337.55 feet; thence North, 1335 feet along the <br /> West line of CSM#6301; thence West along the South line of said NW 1/4 of the SW 1/4, <br /> 16.5 feet to the point of beginning; thence continue West along the South line of said 1/4 <br /> 1/4, 209 feet; thence, North, 668 feet; thence East along the North line of the South (668 <br /> feet) of said 1/4 1/4, 209 feet; thence south along a West line of 16.5 foot acess strip, 668 <br /> feet to the point of beginning. <br /> Part of the W 1/2 of the SW 1/4 Section 15, Town of Rutland described as follows: <br /> TO RH-4: Commencing at the Southwest corner of said Section; thence East along <br /> the South line of said W 1/2 of the SW 1/4, 752.0 feet to the point of beginning; thence <br /> continue East 585.55 feet; thence North along CSM #6301, 1335.00 feet; thence West <br /> along the centerline, of CTH A; 225.5 feet; thence North 668 feet; thence West along the <br /> North line of the South 668 feet, of said W 1/2 SW 1/4; thence South along the West line <br /> of said W 1/2 SW 1/4, 668 feet; thence East along the North line of CSM#1685, 457.62 <br /> feet; thence South along said CSM #1685, 288.67 feet; thence East along said CSM <br /> #1685, 321.54 feet; thence South along said CSM #1685,. 1046.76 feet to the point of <br /> beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3Xa)2.(b)of the Dane County Code of <br /> Ordinances. The rezoned area shall be subject to the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed description/s is/are intended to describe land for which a certified survey map will be prepared <br /> for approval and recorded This amendment will become effective, if within 90 days of its approval by Dane <br /> County,a certified survey map that describes the land to be rezoned is recorded in the office of the Dane County <br /> Register of Deeds. Failure to record the survey will cause the rezone to be null and void. Two copies of the <br /> recorded survey shall be submitted to Dane County Zoning. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective,if within 90 days of its adoption by Dane County the owner or owners of the <br /> land shall record the following restrictions on said land: <br /> 1.To prohibit further residential development on the RH-4 rezone areas. <br /> Said restriction shall run in favor of Dane County and the pertinent Town Board as well as the owners of <br /> land within 300 feet of the site.Failure to record the restrictions will cause the rezone to be null and <br /> void. <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,to be <br /> consistent with the provisions of Wisconsin State Statute 91.77(1)(a),(b),(c). <br />
