Plan Commission Action Report <br /> Clay Mine Reclamation— CUP 1478 <br /> The Ziegler Farm <br /> J & H of Wisconsin Inc. <br /> The Plan Commission Meet on Wednesday February 6, 2002 to discuss and take <br /> possible action on the reclamation of the Clay Mine on the Ziegler Farm. The farm is <br /> located in the far north area of the Town off of I-94 Frontage Road which intersects with <br /> Sprecher Rd. by the Interstate. The date of the CUP and reclamation plan was October <br /> 20, 1993. The CUP has expired and J &H of Wisconsin has ceased operations. <br /> The Plan Commission has spent a number of weeks on this issue. The elevations <br /> of the reclamation plan of 1993 were not possible because of pipelines going through the <br /> property. J &H supplied a map of the current elevations. We were able to determine the <br /> discrepancies of the plan vs. actual. The general flow on the reclamation plan was from <br /> northwest to southeast on the property to a wetland. The actual elevations in the property <br /> show a general flow from the northwest to the southeast with an exception of where the <br /> pipelines run through the property. The wetland on the property borders Door Creek. A <br /> visual inspection of the property by plan commission members revealed a number of <br /> stockpiles of topsoil. The complexity of this reclamation required us to ask for help from <br /> the Town Attorney(Mark Hazelbaker). After careful review of all of the documents we <br /> decided there were 2 clear issues we wanted resolved in the reclamation. 1) We wanted <br /> verification from Dane County that the revised grades do not pose any problems <br /> pertaining to Storm Water Runoff. <br /> 2) We also want the owner to make a binding agreement to effectively manage the <br /> stockpiles of excess topsoil to prevent them from eroding into Door Creek. <br /> The Plan Commission by unanimous vote is making a recommendation that the <br /> Town Board approve the reclamation with the revised elevations subject to: <br /> A) Dane County Verification that the revised elevations do not pose any <br /> problems pertaining to Strom Water Runoff. <br /> B) The owner makes a binding agreement to effectively manage the stockpiles of <br /> excess topsoil, to prevent erosion into Door Creek. <br />
