Guthrie, Mead & Hunt <br /> During the February 24, 1998 public hearing on Petition#7149, there were questions raised <br /> about the status of the U.S. Army Corps of Engineers permit for the proposed wetland fill. and <br /> about the appropriate legal description to be used for the rezoning petition. Since then. both of <br /> these issues have been resolved. <br /> Earlier this week, Robin Carley dropped off a copy of U.S. Army Corps of Engineers Permit No. <br /> 98-00562-NW-JBK, approved on November 3, 1997 (in petition file). This permit authorizes the <br /> fill of up to 1/3 of an acre of wetland, corresponding to the area to be filled to allow for the <br /> access road as shown on the Deer Haven Development preliminary plat. Ron Guthrie, of Mead <br /> & Hunt, Inc., has provided us with a legal description of the fill area to be rezoned (in file). <br /> Given this information, if the committee chooses to approve the petition, I would suggest the <br /> following: <br /> 1. The petition be amended to rezone only the 1/3 of an acre (described in the most <br /> recent legal description) out of the wetland district. <br /> 2. Once the rezone becomes effective, the County should formally request that the DNR <br /> amend the Wisconsin Wetland Inventory to reflect both the rezoned 1/3 of an acre and <br /> the delineated wetlands as shown in the Deer Haven Development Preliminary Plat. <br /> 3. The County board adopt the updated Wisconsin Wetland Inventory maps, when <br /> delivered by DNR, as the official wetland district zoning maps and incorporate them into <br /> the ordinance. <br /> I have spoken with the applicant, the surveying firm and the County Zoning Administrator, who <br /> all concur with the above.
