COMPOSITE REPORT-Page 3 Application No. CUP 1479 <br /> DANE COUNTY PLANNING DIVISION STAFF COMMENTS (2/24%98) <br /> I. BACKGROUND <br /> A. The applicant is requesting a conditional use permit to allow construction of 44 <br /> apartment units in the B-1 Local Business District. Apartment units are conditional uses <br /> when constructed as part of a building housing a permitted use in the B-i district. The <br /> applicant's development proposal also contains first-floor retail uses in the two <br /> apartment buildings and a convenience store in a separate building. <br /> B. The subject property is in the Town of Westport, along CTH M and 1/2 mile west of <br /> STH 113. The property is in the central urban service area, where public sewer and <br /> water services can be provided. <br /> II. ANALYSIS <br /> A. The 5.8 acre subject property is currently undeveloped. It is in an area created by a loop <br /> street off of CTH M called Willow Road. Willow Road has a rural road cross section. <br /> B. A navigable stream runs north to south through the western part of the subject property. <br /> The project as proposed would require filling and grading within 300 feet of that stream. <br /> The applicant would have to apply for and receive a special exception permit from the <br /> Board of Adjustment before any earthmoving could occur in this area. An erosion <br /> control plan would also have to be submitted and approved by the County for the entire <br /> project before construction. <br /> C. The subject property is located within a developing area. Located across Willow Road <br /> to the south are the WestshireVillage condominiums, which are marketed to retirees. <br /> That project is on approximately 38 acres rezoned to R-4 in 1969. The condominium <br /> plat which led to the 307 housing unit project was not recorded until 1996. The <br /> development density is approximately 8 units per acre. The development contains a <br /> range of housing types, ranging from single family homes to 3 story apartment buildings. <br /> Dwelling units near Willow Road include mainly three- and four-unit single story <br /> buildings. The project has been partially completed to date. Other properties in the area <br /> contain a mix of residential and commercial uses. <br /> D. The applicant proposes a mixed residential and commercial development on the site(see <br /> Exhibit A). That plan includes two mixed residential and commercial buildings. Each <br /> building would be 2 1/2 stories in height, and would contain 22 residential units and 45 <br /> underground parking spaces. Each building would also contain approximately 6,100 sq. <br /> ft. of first floor retail uses, and would be served by 69 outdoor parking spaces. The main <br /> parking lot would have two accesses along Willow Road, directly across from existing or <br /> planned access roads to the Westshire Village development. The subject site would also <br /> contain an approximately 6,000 sq. ft. convenience store, with what appears on the site <br /> plan to be four islands for gasoline pumps and a drive-through car wash. Although this <br /> CUP is for the residential uses, the applicant should note that gas pumps and car washes <br /> are not allowable uses in the B-1 district. The site plan also includes one to two acres of <br /> open space between the residential/commercial buildings and Willow Road, intended in <br /> part as a recreational area for residents. The residential development density on the <br /> property would be about 8 units per acre, not considering commercial uses. <br />
