This access easement shall be a <br /> driveway and shall provide ingress and egress for the owners of <br /> said Lots 1 and 2 and Parcel A. <br /> This access easement is intended to provide said owners with <br /> a reasonable means of access from Otto Kerl Road, a public high- <br /> way. This access easement shall pass with each said Lots 1 and <br /> 2 and Parcel A as an appurtenance thereto and, except as other- <br /> wise provided herein, may not be severed, transferred, assigned <br /> or otherwise alienated separate or apart from each said parcel. <br /> Easement to Government Grantor does hereby create, establish, <br /> dedicate and grant a permanent and perpetual easement to the <br /> United States, State of Wisconsin, Dane County and Town of Berry <br /> and to their respective agencies , departments or branches and the <br /> employees, agents and representatives thereof, over, across, <br /> through and upon the described easement real estate for the pur- <br /> pose of performing such duties and activities related to law en- <br /> forcement, fire protection and medical and emergency situations <br /> on or for any portion of said Lots 1 and 2 and Parcel A or any <br /> person thereon. In the event, gates control, limit or restrict <br /> vehicular or pedestrian access to and from.any portion of the <br /> described easement real estate, the gates shall be constructed <br /> as breakaway type gates and all governmental authorities are <br /> authorized to break through said gates, if necessary, in an enter- <br /> gency situation, and shall not be liable for any damage caused <br /> by said emergency entry. <br /> -2- <br />
