May 21, 1998
TO: ZNR and County Planning
FROM: Town of Berry Board and Planning Commission
RE: Yelk Petition
The Planning Commission and the Town Board approved the request after doing a site
visit. The landowner is entitled to 3 splits according to the Town's land use plan. The
layout of the three parcels takes the least amount of farmland out of production.
We took in consideration amongst other concerns, the following:
The town's requirement to take the least amount of land out of production farm
land
The town's driveway ordinance
The County's and Town's subdivision rules
The County's 66' rule (pre April 1998)
Therefore, the town approved the request since the request took the least amount of
farmland out of production and the productive lands are accessible by the current farmer.
Additional comments:
The landowner has been in contact FSC conservation
Using the pre-April 1998 County's 66' frontage rule,
The County and Town are always concerned about the quantity of driveways
coming onto a public road and have been utilizing shared driveways,
where necessary, for increased highway safety. With this request, there is
only 1 driveway, not 3 coming onto the highway.
Request rezone of RH, not A2 since the lands are not productive.
Bill Carlson
Butch Wendt
Stan Theis
Barb Ripp-Statz
Joe Hodgson
Virgil Theis
Mel Bankes
