The basis of this <br /> I I' determination is as follows: <br /> t <br /> 6/15/72 zoning permit issued for construction of kennel in the A-1 <br /> Agriculture District. Property was represented as being a <br /> minimum of 5 acres with a minimum 250' width which complied <br /> with ordinance requirements. Recent information has disclosed <br /> that the area was less than 5 acres net and therefore the use <br /> I should not have been permitted and, in fact, was illegal. <br /> 1 <br /> 7/15/81 Ordinance Amendment (OA) #2691. Kennels no longer permitted in <br /> the A-1 district, kennels were made a permitted use in the A-2 <br /> district. An existing legal kennel in the A-1 district would <br /> have been made nonconforming. Malagold remained illegal. <br /> i <br /> 6/15/83 OA #2999 A-2 Ag Dist. deleted the minimum 5 acre, 250' width <br /> ; requirement for kennels. <br /> 4/29/88 LIRezone from A-1 to A-2, on the Malagold property, was <br /> effective. Although this rezone was submitted for another <br /> purpose, a residence for a caretaker, the rezone also legalized <br /> the kennel use because kennels were a permitted use in the A-2 <br /> 3I district and minimum area requirements had been removed, see <br /> 7/15/81 and 6/15/83 above. <br /> l'i 7/6/88 OA #36, 1987-88. Required a Conditional Use Permit (CUP) for <br /> , kennels. This amendment caused Malagold Kennel to be <br /> nonconforming. Kennel use is therefore restricted to what <br /> .0' at that time including all aspects of the kennel usage <br /> e.g., area, size of buildings and number of kennel cages, etc. <br /> 4: <br />
