DANE COUNTY ORDINANCE AMENDMENT NO. 7156 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Blue Mounds. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Blue Mounds be amended to include in the RH-2 Rural Homes <br /> District/s the following described land: <br /> PETITION NUMBER: 7156 <br /> Part of the NE 1/4 of the NE 1/4 of Section 35, and part of the NW 1/4 of the NW 1/4 <br /> Section 36, Town of Blue Mounds described as follows: Commencing at the Northeast <br /> corner of said Section 35; thence West 215 feet to the point of beginning; thence S53°14' <br /> West 422 feet; thence S07°29' East 520 feet; thence N89°09' East 537 feet; thence <br /> N44°32' East 590 feet; thence S41°04' East 80 feet to the centerline of Town Road; <br /> thence N16°01' East 250 feet; thence S44°32' West 750 feet; thence N25° West, 750 feet <br /> to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b)of the Dane County Code of <br /> Ordinances. The rezoned area shall be subject to the following conditions. <br /> CER'I DIED SURVEY REQUIRED <br /> The above listed description/s is/are intended to describe land for which a certified survey map will be prepared <br /> for approval and recorded. This amendment will become effective, if within 90 days of its approval by Dane <br /> County,a certified survey map that describes the land to be rezoned is recorded in the office of the Dane County <br /> Register of Deeds. Failure to record the survey will cause the rezone to be null and void. Two copies of the <br /> recorded survey shall be submitted to Dane County Zoning. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane County the owner or owners of the <br /> land shall record the following restrictions on said land: <br /> 1. That there shall be no further residential development excluding parcel identified in this petition,on <br /> the original 96 acre farm, except that the applicant would be allowed one secondary farm residence on the <br /> balance of the acreage included in parcels 0606-253-9190.0606-351-8000,0606-362-8501. <br /> Said restriction shall run in favor of Dane County and the pertinent Town Board as well as the owners of <br /> land within 300 feet of the site. Failure to record the restrictions will cause the rezone to be null and <br /> void. <br /> _ <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon their findings, to be <br /> consistent with the provisions of Wisconsin State Statute 91.77 (1)(a),(b),(c). <br />
