Developer shall make and install required improvements <br /> in conformance with this Agreement on the following schedule: <br /> (A) Developer shall install public water and a 12 foot width of the 10" base for the <br /> extension of Duraform Lane from Blanchar's Crossing to the northeasterly <br /> corner of the proposed CSM Lot,which shall serve as a temporary public road <br /> access to said proposed CSM Lot, together with soil erosion and stormwater <br /> control measures approved by Dane County, no later than November 30, 1997; <br /> (B) All other public improvements identified on Attachment B shall be installed no <br /> later than October 31, 1998. <br /> 6. Utilities. The Developer shall be responsible for making all arrangements with <br /> the appropriate utility services for necessary disconnections, reconnections and relocations of <br /> their facilities, as may be required for the completion of the improvements pursuant to this <br /> Agreement. <br /> 7. Conditions Preceding Construction. The Town shall not issue any construction <br /> or grading permits for the Subject Realty and the Developer shall not commence construction <br /> of the required improvements prior to the time that: <br /> (A) The required security described herein has been determined by the Town <br /> Engineer, approved as to form by the Town Attorney and filed with the Town <br /> Clerk-Treasurer. <br /> (B) The Town Engineer has approved: <br /> i) the preliminary construction plan, and specifications for the Duraform <br /> Lane extension and for North Towne Road, from its intersection with <br /> Duraform Lane southerly approximately 900 feet to the high point in <br /> elevation on said North Towne Road; <br /> ii) the final construction plans and specifications for the remaining items <br /> identified in Section 5(A), above; and <br /> iii) and a traffic regulation and control plan to be implemented during the <br /> construction project. <br /> (C) The contractor(s) selected by the Developer to construct said public <br /> improvements has provided a Certificate of Insurance to the Town naming the <br /> Town of Windsor as an additional insured for general liability in the amounts <br /> of $1,000,000 individual bodily injury or death, $3,000,000 single accident, and <br /> $1,000,000 property damage. <br /> (D) The Code Enforcement Officer has determined that the Developer has installed <br /> the approved soil erosion and sedimentation controls required by Dane County <br /> Land Conservation as provided in the approved Plans and Specifications. <br /> 97032 i.11c0.110697k kahjm <br /> Dodcicp.agr <br />
