In April, 1997 I <br /> submitted a petition to rezone(6916)a small area where I intent to place my house. This request was approved <br /> by the Deerfield Town Board prior to my petition to Dane County. However, in his composite report, Tom <br /> Smiley took issue with the present density of housing in the area. He also said that if I intended to transfer <br /> development writes that I would need to make a public disclosure. <br /> At my public hearing, John Hendrick suggested that my petition be tabled due to the issues mentioned in the <br /> composite report. He also went on to ask me if I had any other property in Dane County from which I could <br /> transfer development rights. Based on the comments of Mr. Hendrick and others, and after consultation with <br /> my attorney(Larry Bechler), I decided to have my petition held in abeyance until I could collect more information <br /> about the problem and possible solutions. In June I received a letter (dated June 16) from Steve Reynolds <br /> stating that my petition would not be acted upon until such time that I transferred development rights. <br /> I have spent much of the past 9 months looking at all the details of the previous zoning activity on the Hommen <br /> farm and have consulted extensively with Norb Scribner and Tom Smiley. I have made no progress toward <br /> accomplishing my rezone in the normal way. Most recently, since I am intending to build this spring, I decided <br /> to request a zoning permit based on the Ag income requirement. I took all the necessary steps. I obtained a <br /> conservation plan from LLC. I arranged a multi-year crop share lease with a local farmer which would provide <br /> the necessary income and I met with the Deerfield Town Planning Commission for their approval of my <br /> conservation plan as stated by the Dane County instructions. The Deerfield Town Planning Commission denied <br /> approval of my conservation plan, again citing the density issues. Apparently Art Mikkelson (Chair)spoke with <br /> Steve Reynolds prior to the meeting and was informed by Steve that the same problem exists even for a farm <br /> residence. One member of the Deerfield Planning Commission suggest that I transfer development rights in <br /> order to accomplish my rezone as Walter Olson had done before. Upon further discussion, all members of the <br /> Planning Commission,who were present,said that they would support such a transfer. <br /> This decision to deny my conservation plan left me with no alternative but to pursue the transfer of development <br /> rights alternative, which was previously suggested by Hendrick, Smiley and Reynolds. I have accomplished <br /> said transfer. David Muehl (Badger Farms LLC)who owns 362 acres of land in the Towns of Cottage Grove <br /> and Deerfield has agreed to transfer the development rights from a 35 acre parcel. The land in question lies <br /> entirely within the Town of Deerfield. The Transfer of Development Rights document is enclosed. In light of this <br /> fact, I would like to request that my petition be put on the agenda for the next ZNR work meeting March 19. <br /> Sincerely, <br /> Richard K.
