I <br /> 7 <br /> DANE COUNTY ORDINANCE AMENDMENT NO. 6921 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Madison. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Madison be amended to include in the C-2 Commercial District/s the <br /> following described land: <br /> PETITION NUMBER: 692 1--Part of the Northwest 1/4 of the Southeast 1/4 of Section 35,Town <br /> of Madison described as follows: Commencing at the center of Section 35,said point also being the <br /> Northwest corner of the Southwest 1/4 of Section 35; thence South 0°52'55"East along the North-South <br /> 1/4 line 1569.07 feet; thence North 59°44'45"East 848.56 feet to the center line of Old United States <br /> Highway 13 and the point of beginning; thence continuing North 59°44'45"East 53.20 feet; thence <br /> North 19°48' 15"West, 337.80 feet to the Southerly right of way line of United States Highway 12& 18; <br /> thence North 70° 11'45"East along Southerly right of way 521.16 feet to the Westerly right of way line <br /> of the Chicago&Northwestern Railway; thence South 00° 10'45"West 335.09 feet; thence North 89° <br /> 49' 15"West 15 feet; thence South 00° 10' 15"West 247.75 feet; thence South 61°08' 15"West 320 <br /> feet more or less to the center line of the original State Highway No. 13; thence Northwesterly along said <br /> center line to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b)of the Dane County Code of <br /> Ordinances. The rezoned area shall be subject to the following conditions: <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective,if within 90 days of its adoption by Dane County the owner or owners of the <br /> land shall record the following restrictions on said land: <br /> That only the following uses shall be allowed on the rezone area: <br /> 1. All uses permitted in the 10.13 (C-1). <br /> 2. Major repair of motor vehicles; sales of new and used vehicles; sales of new and used contractor's <br /> machinery and equipment;repairs, storage and service of contractor's machinery and equipment;rental <br /> and leasing of motor vehicles, contractor's machinery and equipment;utility services;parking or storing <br /> of motor vehicles;warehouses;games such as horseshoes,volleyball or similiar activities not lighted for <br /> night operation;mini-warehouses. <br /> Said restriction shall run in favor of Dane County and the pertinent Town Board as well as the owners of <br /> land within 300 feet of the site. Failure to record the restrictions will cause the rezone to be null and <br /> void. <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,to be <br /> consistent with the provisions of Wisconsin State Statute 91.77(1)(a),(b),(c). <br />
