Our plan allows the owner of property previous to our ordinance <br /> effective date (12/24/74) to sell his original home and build for his own use on the <br /> property- or sell or convey a lot to his children from that original parcel. Mr. Schwoegler <br /> meets our requirements, as he is selling the home to a daughter. Our vote of support also <br /> requested that the remainder of the original parcel (0909-293-9000-3) be deed restricted <br /> from any further residential land divisions or building. The County approval placed deed <br /> restrictions on all parcels owned by Mr. Schwoegler and not as sought by the town. <br /> The town is not likely to support any further building on parcel # 0909-9500-8 either, but <br /> feels that should be done as directed by the town plan and not prior deed restrictions for <br /> actions that do not involve that parcel. <br /> I am enclosing a map of the parcels owned by Mr. Schwoegler. Only the parcel on which <br /> the land division is requested-should be deed restricted I am returning the resolution as <br /> not approved, as Mr. Harare indicated your conversation suggested we should do. I am <br /> then enclosing a new Town Board Action Report indicating our vote to support the <br /> original petition- but with the request that only one parcel be deed restricted and as our <br /> vote and intent.
