DEED RESTRICTION PAGE 2 1 . New building no bigger than 40' by 110' and replacement of the three structures is permitted if the structures would be burned or destroyed. 2 . Activities : Outside activities will be restricted to: a. Machinery auctions. b. Specialty livestock auctions . c. Unusual and small animal auctions . d. Hay auctions. e. Overstock of items for building. f. Only one outside auction per week of the above five. g. No amplification outside when amplification is occurring inside. Only wireless amplification can be used outside. 3 . Auctions - 10: 00 A.M. to 10: 00 P.M. a. No more than four auctions per week. 4 . Sunday - 11 : 00 A.M. to 7 : 00 P.M. 5. Property owner will take responsibility for checking parking area for refuse at the conclusion of the activities . 6. Property owner will be responsible for planting and maintaining area surrounding parking lot to reduce run off and erosion to neighboring property. 7 . Refuse container will be screened from public view. 8 . No fermented or malt beverages may be sold or served. 9. No parking or public road ways will be permitted. 10 . Lighting of parking lot will be turned off 1/2 hour after activities are over, only security lights on building will remain on and will be directed downward. 11 . A chain gate is to be put across driveway when auction activities are not held. 12 . Temporary storage and parking of trailers will be confined to the loading zone. 13 . The primary business purpose will be auctions . 14 . To incorporate the approved site plan dated June 30, 1997, the only use in the C-2 is for auctions . These restrictions shall constitute covenants running with the land and shall be binding upon all parties now owning any part of said land, their successors, heirs and assigns, and all parties holding under them unless, pursuant to paragraphs 5 or 6 of this instrument, said restrictions are amended or terminated.
