DEED RESTRICTION <br /> PAGE 2 <br /> 1 . New building no bigger than 40' by 110' and replacement of the <br /> three structures is permitted if the structures would be burned <br /> or destroyed. <br /> 2 . Activities : Outside activities will be restricted to: <br /> a. Machinery auctions. <br /> b. Specialty livestock auctions . <br /> c. Unusual and small animal auctions . <br /> d. Hay auctions. <br /> e. Overstock of items for building. <br /> f. Only one outside auction per week of the above five. <br /> g. No amplification outside when amplification is occurring <br /> inside. Only wireless amplification can be used outside. <br /> 3 . Auctions - 10: 00 A.M. to 10: 00 P.M. <br /> a. No more than four auctions per week. <br /> 4 . Sunday - 11 : 00 A.M. to 7 : 00 P.M. <br /> 5. Property owner will take responsibility for checking parking <br /> area for refuse at the conclusion of the activities . <br /> 6. Property owner will be responsible for planting and <br /> maintaining area surrounding parking lot to reduce run off and <br /> erosion to neighboring property. <br /> 7 . Refuse container will be screened from public view. <br /> 8 . No fermented or malt beverages may be sold or served. <br /> 9. No parking or public road ways will be permitted. <br /> 10 . Lighting of parking lot will be turned off 1/2 hour after <br /> activities are over, only security lights on building will remain <br /> on and will be directed downward. <br /> 11 . A chain gate is to be put across driveway when auction <br /> activities are not held. <br /> 12 . Temporary storage and parking of trailers will be confined to <br /> the loading zone. <br /> 13 . The primary business purpose will be auctions . <br /> 14 . To incorporate the approved site plan dated June 30, 1997, <br /> the only use in the C-2 is for auctions . <br /> These restrictions shall constitute covenants running with the land <br /> and shall be binding upon all parties now owning any part of said <br /> land, their successors, heirs and assigns, and all parties holding <br /> under them unless, pursuant to paragraphs 5 or 6 of this <br /> instrument, said restrictions are amended or terminated. <br />
