G7v kC TOWN BOARD ACTION REPORT Regarding Zoning Petition # 9 9 9 Public Hearing 6/zq/247 Whereas, the Town Board of the Town of RURLAND having considered said zoning petition, be it therefore resolved that said petition is hereby (Approved). The Town Planning Commission, consisting of 7 members voted 6 in favor and o opposed. The Town Board, consisting of 4 members voted 4 in favor and 0 opposed. The above petition is subject to the following conditions: (Cross out or write none if there are no conditions) This petition is approved conditioned upon the approval of three deed restrictions as follows:1)Prohibiting further division of Lot I - the original residence with four acres, Lot 2, - the newly created 5.5 acre wooded parcel, and the 12 acre separate parcel; 2) To record the easement for the HAP of the 66' driveway access the three anewurh parcels and the Breedlove 15 acre parcel; and finally, 3) that the placement of the well on the newly created 5. 5 acre parcel he made in accnrdanre with the Dla standards as_ it is adjacent to an existing landfill. (attach additional page(s)as required) Please note; If the proposed rezoning is approved by the Town Board, but this rezone does not comply with the Town Land Use Plan, please explain the approval. Thes i,-S ons are critical for the Zoning Committee and the County Board in their consideration of the pet(ti• NOTE REGARDING REGIONAL PLANNING COMMISSION COMMENTS: The Town of Rutland was led to believe that the applicant owned 71 acres on ,Tuna 6, 1978, which is the date the Town's Land Use Plan was adapterl (oat June 7, 19_68 as stated in RPC comments) , and therefore wnuld he allowed one division (Page 8, Town of Rutland Land Use Plan, Agricultural Policy #8.) A copy of the 1978 Plat map indicates he owned at least 1R acres Tt is not the Town's intentiw to go against ir's own Land Use (attach additional page(s)as required) Plan.
