ATTACHMENT TO REQUEST FOR REZONING <br /> This Request for Rezoning is resubmission of a request originally filed in September, <br /> 1996. The applicant, Mark DuPre, d/b/a Need Lettuce Farms, currently owns the property <br /> located directly west of the subject parcel, which is zoned C-1 and described as Lot 2, CSM <br /> 8280. Mr. DuPre intends to expand his current septic field, located on Lot 2, to include the <br /> subject parcel. This change in use requires a change in zoning. In addition, this rezoning <br /> will facilitate transfer of the subject parcel from its current owner, Dane County, to Mr. <br /> DuPre. Dane County sold the subject parcel to Mr. DuPre in escrow, pending approval of <br /> the change in zoning. After that transfer Dane County will continue to own a substantial <br /> amount of land next to the DuPre parcel. <br /> The original Request for Rezoning, Rezoning Petition 6743, previously received all <br /> required approvals by the Town, Zoning Committee, Dane County Board and the County <br /> Executive. One condition of approval was imposition of a deed restriction restricting usage <br /> of the property to a septic field. A copy of that restriction, to which Mr. DuPre consents and <br /> will record upon approval of this request, is attached as Exhibit B. However, a second <br /> condition of approval required recording of a certified survey of the subject parcel. <br /> Ordinarily, a certified survey is not required when property is conveyed from one adjoining <br /> landowner to another (here Dane County to Mr. DuPre) and the conveyed property will <br /> thereafter not be conveyed separately from the remaining transferee property. Section <br /> 75.14(3), Dane County Ordinances. Applicant hereby agrees that such a deed restriction may <br /> be placed on the subject parcel to comply with this requirement. <br /> However, the originally submitted application inadvertently stated that applicant <br /> would be filing a certified survey map of the subject property. Even though no such survey <br /> map is required, it was made a condition of the rezoning approval because of the statement <br /> contained in the application. That statement is not contained in the new application. <br /> Accordingly, applicant requests that the subject property be rezoned from A-1 <br /> (exclusive) to commercial C-1, with the septic system and "no separate conveyance" deed <br /> restrictions, but without the need for a certified survey map. <br /> F:\DOCS\WD\23218\0\RD3169.WPD <br />
