2.The execution and recording of easements between Mr.Reible,WDNR,and the Council that <br /> restrict uses of the land to those generally described in a,b,c,d below and consistent with the <br /> protection of eagle habitat. <br /> Pet. #6960-cont. <br /> Page 4 <br /> a.A limit on the overall density of development,limiting the entire 40 acre tract(in both Dane <br /> and Columbia Counties)to no more than ten,single family residential dwelling lots and no more <br /> than eight single family residential lots being located east of highway 188.(Of the eight lots east <br /> of highway 188,five would be in Dane County and three would be in Columbia County.)Once <br /> created,each of the ten lots would be restricted from any further subdivision regardless of <br /> changes in zoning law that may occur in the future. <br /> b. Limit exterior construction activity on the lots to the period of March 1 to October 30,to <br /> minimize disruption of the site during winter months when eagles are in the area. <br /> c.Identify any environmentally sensitive areas within the proposed residential lots and limit or <br /> prohibit construction within those identified areas. <br /> d.Grant the Ferry Bluff Eagle Council the affirmative right to manage vegetation in portions of <br /> the residential lots that provide an immediate buffer area to the rest of the Round Top Bluff <br /> outlot.These affirmative rights would include the right to manage the vegetation in the buffer <br /> area. <br /> 3.The execution of option agreement beyween Mr.Reible and WDNR to purchase the river <br /> bottom unbuildable outlot as designated on the Certified Survey Map(s)or plat.(lot 1 on the <br /> concept map dated July 31, 1997). <br /> 4.The execution of option agreement between Mr.Reible and WDNR to purchase an easement <br /> affecting approximately 6 acres that include Round Top Bluff for its value as determined by an <br /> appraisal prepared for the WDNR. <br /> 5.The execution of an option agreement between Mr.Reible and the Council to purchase fee title <br /> to approximately 6 acres that include Round Top Bluff as an unbuildable outlot designated on the <br /> Certified Survey Map(s)or plat for its residual value as determined by an appraisal prepared for <br /> WDNR after the restrictions of WDNR have been placed on the title.(lot 9 on the concept map <br /> dated July 31, 1997). <br /> 6.The concept map dated July 31, 1997 with appropriate zoning classifications shall apply. <br /> 7.To require the removal of all buildings on the proposed lots with the exception of the <br /> building(s)located on lot#2. <br /> 8.That there shall be no development in the floodplain. <br /> (&2\ ' <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon their fmdings,to be <br /> consistent with the provisions of Wisconsin State Statute 91.77(1)(a),(b),(c). <br />
