PLANNING& DEVELOPMENT <br /> 13,rryny RECORDS <br /> Dane County Zoning Administrator <br /> City County Building <br /> Martin Luther King Drive <br /> Madison, WI 53709 <br /> Dear Sir: <br /> After going through rezoning in 1989 to purchase The Lodge at 7191 Elder Lane, Sun Prairie, in 1990, it is now <br /> apparent that either the former owner or I were incorrectly advised and that uses of the Metal Building there <br /> dating back at least to 1989 do not meet the zoning code. A complaint in your file concerning the current use o: <br /> that building, which is automotive repair and rebuilding,has caused us to apply for rezoning and has resulted in <br /> recommendation from the Town of Bristol for denial due to neighbor complaints. <br /> After discussing the matter with Gerald Derr,Town Chairman, I would like to propose the following, which he h <br /> verbally agreed to support: <br /> The operation of an automotive repair business on the site will cease by the end of September, 1997. The tenant <br /> Ed Conn, who also lives in an apartment on site, will be required to remove his sign,the tires, any debris, and al: <br /> vehicles, house trailers, etc. from the front of the building by that time. He will be permitted, if satisfactory <br /> overall arrangements can be made,to park a maximum of five vehicles on site which belong to him. This woulc <br /> include his tow/plow truck and a truck with a 14 foot box from which he intends to operate a mobile repair <br /> business. He will be permitted to work on his own and my vehicles on site inside the shed,but may not create <br /> noise which can be heard outside the shed between 7 p.m. and 7 a.m. If he gets towing calls, he may not tow th <br /> vehicles back to this property. He may not have any non licensed or non operable vehicles parked outside the <br /> shed and a maximum of two inside and they must be included in his total of five. <br /> The currently pending zoning matter will be referred back to the Town. We will then work with the Town to <br /> obtain a recommendation for approval of the request with the restriction that the only permitted uses of the C2 <br /> area will be engineered mini-warehouse storage with the design and site plan subject to review and approval of 1 <br /> Town except for the shed,which may have uses already permitted in the B1 district and uses incidental to the <br /> operation of my property management business. Mr. Conn does in fact plow snow for me and tow abandoned <br /> cars from my apartment parking lots and would continue to do so with the restriction that the cars would be <br /> parked out of site behind my Lodge building and would be removed from this site as soon as the statutory time f <br /> storing them has elapsed. <br /> Sincerely, <br /> Evan D.
