COMPOSITE REPORT-Page 5 Application No. 6963/1440 4. Modifications/Additions to site. 5. Expansion plans. I. On July 22, four citizens spoke at the ZNR Committee public hearing. The applicant and Town Chair spoke in favor of the petition. A farm owner to the south did not oppose the convenience store, but did oppose fuel sales on the property. He expressed concern over groundwater contamination which could result from leaking underground tanks. Finally, the homeowner directly to the east expressed concern over hours of operation, the impact of underground tanks on water quality, the impact of any filling on the subject property on flooding of adjacent properties, and potential loitering. III. SUMMARY A. If the ZNR Committee and County Board wish to approve the rezoning request, they may wish to enact conditional zoning with the following two conditions. Adding these conditions to the rezoning petition would result in an amended petition which would have to go back to the Town Board for its further action. 1. Before consideration of the conditional use permit for motor vehicle fuel sales, the applicant shall submit an `operations plan"to the Town of Bristol. That plan shall indicate, at a minimum, the number of gas pumps, hours of operation, traffic patterns, proposed modifications or additions on the site, and expansion plans. 2. Use of the subject property shall be limited to the proposed convenience store(including the sale of fuel for motor vehicles if and only if a conditional use permit is granted) plus any other use permitted under S. 10.14(lxa) of the Dane County Zoning Ordinance(i.e. C-1 district permitted uses). B. If the rezoning is approved,the ZNR Committee will then consider the conditional use permit request to allow the sale of motor vehicle fuels. The applicant should submit the following information to the Town and County before the Committee considers action on the CUP: 1. A site plan including all information requested in Section 11(G)above. 2. An `operations plan" containing all information requested by the Town, plus a description of all proposed outdoor activities including outdoor display of merchandise. 3. Specifications(including type of materials, surface preparation, size, monitoring devices) of underground fuel tanks proposed, and a description of permits which have been received or will be required for placement and monitoring of the tanks.
