COMPOSITE REPORT-Page 5 Application No. 6963/1440 <br /> 4. Modifications/Additions to site. <br /> 5. Expansion plans. <br /> I. On July 22, four citizens spoke at the ZNR Committee public hearing. The applicant and <br /> Town Chair spoke in favor of the petition. A farm owner to the south did not oppose the <br /> convenience store, but did oppose fuel sales on the property. He expressed concern over <br /> groundwater contamination which could result from leaking underground tanks. Finally, the <br /> homeowner directly to the east expressed concern over hours of operation, the impact of <br /> underground tanks on water quality, the impact of any filling on the subject property on <br /> flooding of adjacent properties, and potential loitering. <br /> III. <br /> SUMMARY <br /> A. If the ZNR Committee and County Board wish to approve the rezoning request, they may <br /> wish to enact conditional zoning with the following two conditions. Adding these conditions <br /> to the rezoning petition would result in an amended petition which would have to go back to <br /> the Town Board for its further action. <br /> 1. Before consideration of the conditional use permit for motor vehicle fuel sales, the <br /> applicant shall submit an `operations plan"to the Town of Bristol. That plan shall <br /> indicate, at a minimum, the number of gas pumps, hours of operation, traffic patterns, <br /> proposed modifications or additions on the site, and expansion plans. <br /> 2. Use of the subject property shall be limited to the proposed convenience store(including <br /> the sale of fuel for motor vehicles if and only if a conditional use permit is granted) plus <br /> any other use permitted under S. 10.14(lxa) of the Dane County Zoning Ordinance(i.e. <br /> C-1 district permitted uses). <br /> B. If the rezoning is approved,the ZNR Committee will then consider the conditional use permit <br /> request to allow the sale of motor vehicle fuels. The applicant should submit the following <br /> information to the Town and County before the Committee considers action on the CUP: <br /> 1. A site plan including all information requested in Section 11(G)above. <br /> 2. An `operations plan" containing all information requested by the Town, plus a <br /> description of all proposed outdoor activities including outdoor display of merchandise. <br /> 3. Specifications(including type of materials, surface preparation, size, monitoring devices) <br /> of underground fuel tanks proposed, and a description of permits which have been <br /> received or will be required for placement and monitoring of the tanks. <br />
