August 5, 1997 Ruth Robarts <br /> Of Counsel <br /> Dane County Zoning and Natural Resource Committee <br /> City County Building <br /> Madison, WI 53709 <br /> Re: Rezone Petition 6967 <br /> Jon Halverson <br /> Dear ZNR Committee Members: <br /> As a means of introduction, I have been working with Mr. Kent Schroeder, one of Mr. <br /> Halverson's neighbors. <br /> Mr. Schroeder has become one of the spokespersons for a group of neighbors who are <br /> adversely affected by and opposed to Mr. Halverson's petition for rezoning. <br /> Mr. Schroeder has asked me to summarize the reasons this petition should be denied. <br /> 1) THIS PETITION HAS ALREADY BEEN CONSIDERED AND REJECTED <br /> On December 17, 1996, Mr. Halverson submitted Petition#6780 requesting the rezoning <br /> of a parcel of land from A-1Ex to C-2. This petition was duly denied by the Dane County <br /> Board of Supervisors on January 23, 1997. <br /> Section 10.255(1)(c) states no petition for a change in the zoning district boundaries <br /> which has been denied by the Dane County Board of Supervisors shall be resubmitted for <br /> a period of one year from the date of said denial, except on the grounds of new evidence <br /> or proof of change of conditions found to be valid by the zoning committee. <br /> The language of the staff report underscores this is the same proposal which was rejected <br /> only a few months ago. <br /> Petition 6967. This proposed C-2 zoning is similar to a <br /> request(#6780) for the same use at a slightly different site <br /> which had a public hearing in December 1996 and was <br />
