division set forth in the Town of Dunn Land Division Ordinance. Although <br /> the Foundation has not yet submitted a proposed Certified Survey Map, the <br /> Town has made the following determinations regarding the land divisions <br /> described in Section 2(a)(2) of the Grant: <br /> i. The establishment of two residential lots on th Woods Tract, as <br /> described in Section 2(a)(2) of the Grant, is consis ent with the laws, <br /> ordinances and regulations set forth in Section 1.02(2)(A) through(F) <br /> of the Town's Land Division Ordinance, provided that: <br /> (1) No floodplain or wetland area, will be filled or otherwise <br /> disturbed by any construction or development related <br /> activities, and the Town shall have the right to take those <br /> actions it deems necessary to preserve and maintain wetland <br /> areas. <br /> (2) A Certified Survey Map is submitted in the form described in <br /> Sections 1.03(6) and 1.06 of the Town's Land Division <br /> Ordinance. <br /> ii. The conveyance by the Foundation to the Town of the approximately <br /> 3 acre Park as described herein will satisfy the public sites and open <br /> spaces dedication requirement in Section 1.02(4)(B) of the Town's <br /> Land Division Ordinance with respect to the land division described <br /> in Section 2(a)(2) of the Grant. <br /> b. If and when the Foundation requests, the Town shall petition the Dane <br /> County Regional Planning Commission and perform such administrative or <br /> ministerial acts necessary for an extension of the Urban Service Area to <br /> include the residential lots described in Section 2(a)(2) of the Grant. The <br /> Town shall perform such administrative or ministerial acts necessary for <br /> processing of the petition to extend the Urban Service Area. The Town <br /> shall not, however, be responsible for preparation of any documents <br /> necessary to support the petition, or for payment of any fees or costs <br /> associated with the request to extend the Urban Service Area. <br /> c. The Foundation agrees that it will not sell, transfer or assign its rights to <br /> those portions of the Property designated as permitted residences (as defined <br /> in the Grant) to any officer or director of the Foundation, or such officer's <br /> or director's spouse, lineal descendent, parent, sibling, or any corporation, - <br /> H:1WIP\1 1 2 611 5 51PURCH-AGJBE <br /> 0318971731 3 - <br />
