00120f <br /> Deed Restriction <br /> I WHEREAS Raphael Ripp and Betty Ann Ripp are the owners of the following described <br /> real estate in the Town of Black Earth,Dane County,Wisconsin,to-wit: <br /> See Legal Description Attached Hereto. <br /> II WHEREAS said owners desire to place certain restrictions thereon to bind the owners and <br /> those who may acquire title hereafter. <br /> III NOW THEREFORE, in consideration of the mutual benefits passing to and from the <br /> owner and those who may hereafter purchase said land and the parties named as beneficiaries of <br /> these restrictions, the following restrictions are hereby imposed: <br /> 1. The buildable area of Lot 1 shall be limited to an area 250 feet from the centerline of <br /> County Highway"KP and east of the west line of Lot 3 extended. <br /> 2. The buildable area of Lot A shall be entirely within the SE% of the SW' of Section 36. <br /> 3. All of the lots will have one common access point from County Highway"KP". <br /> 4. Lots 1, 2 and 3 which have frontage on County Highway"K?' will not be allowed to use <br /> that frontage for access but will be required to use the shared access drive. <br /> 5: Access points shall be located directly across"KP"from the Ripp driveway. <br /> 6. The rezoned area shall be developed in a manner consistent with the above conditions and <br /> the attached development plan labeled Exhibit A and dated November 18, 1997. <br /> 7. An "easement and maintenance agreement" for the shared access drive shall be executed <br /> and recorded with the Dane County Register of Deeds and a copy of such recorded document shall <br /> be provided to the Zoning Administrator. <br /> IV The restrictions provided for herein shall be enforceable at law or equity against any party <br /> who has or acquires an interest in the land subject to the restriction by the following parties who are <br /> named as grantees,promisees and beneficiaries with enforcement rights: <br /> (a) The County Government of Dane County, Wisconsin provided that the lands are <br /> under the jurisdiction of the zoning ordinance of said County at the time the enforcement action is <br /> commenced, and <br /> (b) The Town Government of the Town of Black Earth, Dane County, Wisconsin <br /> provided that the lands are within the governmental jurisdiction of said Town at the time the <br /> enforcement action is commenced, and <br /> __... _.. .T . <br />
