00120f Deed Restriction I WHEREAS Raphael Ripp and Betty Ann Ripp are the owners of the following described real estate in the Town of Black Earth,Dane County,Wisconsin,to-wit: See Legal Description Attached Hereto. II WHEREAS said owners desire to place certain restrictions thereon to bind the owners and those who may acquire title hereafter. III NOW THEREFORE, in consideration of the mutual benefits passing to and from the owner and those who may hereafter purchase said land and the parties named as beneficiaries of these restrictions, the following restrictions are hereby imposed: 1. The buildable area of Lot 1 shall be limited to an area 250 feet from the centerline of County Highway"KP and east of the west line of Lot 3 extended. 2. The buildable area of Lot A shall be entirely within the SE% of the SW' of Section 36. 3. All of the lots will have one common access point from County Highway"KP". 4. Lots 1, 2 and 3 which have frontage on County Highway"K?' will not be allowed to use that frontage for access but will be required to use the shared access drive. 5: Access points shall be located directly across"KP"from the Ripp driveway. 6. The rezoned area shall be developed in a manner consistent with the above conditions and the attached development plan labeled Exhibit A and dated November 18, 1997. 7. An "easement and maintenance agreement" for the shared access drive shall be executed and recorded with the Dane County Register of Deeds and a copy of such recorded document shall be provided to the Zoning Administrator. IV The restrictions provided for herein shall be enforceable at law or equity against any party who has or acquires an interest in the land subject to the restriction by the following parties who are named as grantees,promisees and beneficiaries with enforcement rights: (a) The County Government of Dane County, Wisconsin provided that the lands are under the jurisdiction of the zoning ordinance of said County at the time the enforcement action is commenced, and (b) The Town Government of the Town of Black Earth, Dane County, Wisconsin provided that the lands are within the governmental jurisdiction of said Town at the time the enforcement action is commenced, and __... _.. .T .
