DECLARATION OF USE RESTRICTIONS DRAFT <br /> WHEREAS,Kyle D. Voss and Zi-Qing Ye, <br /> husband and wife, (hereinafter referred to as "Owners") <br /> are the owners of a certain parcel of real estate described <br /> as follows: <br /> Lot Two (2), of Certified Survey Map <br /> No. 4544, recorded in the Dane County <br /> Register of Deeds Office, in Volume 20 <br /> of Certified Survey Maps, pages 13 and <br /> 14, as Document No. 1861177, as <br /> corrected by Affidavit of Correction, THIS SPACE RESERVED FOR RECORDING DATA <br /> recorded on April 28, 1986, as RETURN TO: Attorney John A.Heibl <br /> Document No. 1932190, in the Town of 900 John Nolen Drive <br /> Madison,WI 53713 <br /> Middleton, Dane County, Wisconsin; <br /> and <br /> Tax Parcel No.: 19-0708-302-8500-4 <br /> WHEREAS, Owners wish to subdivide said parcel with a three (3) lot certified survey map, <br /> pursuant to applicable Town of Middleton and Dane County ordinances; and <br /> WHEREAS, the Town of Middleton will approve the proposed three (3) lot certified survey <br /> map, conditioned upon the imposition of certain restrictions on the permitted use of property in the <br /> proposed certified survey map; and <br /> WHEREAS,Owners are willing to accept said conditions; <br /> NOW, THEREFORE, in consideration of the Town of Middleton conditionally approving <br /> their proposed three (3) lot certified survey map of the above-described real estate, Owners hereby <br /> agree that the permitted use of property in the proposed certified survey map shall be limited as <br /> provided in this Declaration. <br /> 1. Permitted use of the Property. Notwithstanding the Al-Agriculture zoning on the said <br /> property, Owners agree that no agricultural uses shall be permitted, including, but not limited to, any <br /> type of animal husbandry or the raising of field crops for feed, grain or commercial canning; except the <br /> raising of flowers, fruits, vegetables, trees and shrubs for use by the Owners or residents or for <br /> incidental sale shall be permitted.. The raising of domesticated pets shall be permitted, except there <br /> shall be no raising of any cattle, horses, swine or sheep as pets, nor any species of animal for purposes <br /> of selling meat, milk, fleece or breeding stock. <br /> 2. Prohibited Seasonal Storage. The seasonal storage of recreational equipment and motor <br /> vehicles owned by private individuals other than those residing on the premises on proposed Lot 2 is <br /> prohibited outside of the existing barn and shed on proposed Lot 2. <br /> 3. Safe and Sanitary Maintenance of Property. The existing barn and all exterior property <br /> areas on said Lot 2 shall be properly maintained in a clean, safe and sanitary condition, free from <br /> 1 of 2 <br />
